AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, CLOSING AND PERMANENTLY
ABANDONING ELEVENTH STREET BETWEEN THE NORTHERLY RIGHT-OF-WAY
LINE OF DESOTO STREET AND THE SOUTHERLY RIGHT-OF-WAY LINE OF
MONTROSE STREET," ACCORDING TO THE OFFICIAL MAP OF THE CITY
OF CLERMONT, RECORDED IN PLAT BOOKB, PAGES 17-23, INCLUSIVE,
PUBLIC RECORDS OF LAKE COUNTY, FLORIDA; RESERVING UNTO THE
CITY OF CLERMONT A UTILITY EASEMENT; PROVIDING FOR AN EFFEC-
TIVE DATE; AND PROVIDING FOR PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT:

SECTION L
17-23, inclusive, Public Records of Lake County, Florida, be and the same is hereby
closed and permanently abandoned;
SUBJECT, HOWEVER, to this RESERVATION of a permanent utility easement and
right-of-way over, across, under and through the following described property:
Begin at the S.W. corner of Lot 20, Block 113, City of
Cl ennont. Proceed West, para 11 el to the center 1 i neu5f
DeSoto Street 5 feet to the point of beginning. Proceed
West from P.O.B. 50 feet to a point; thence North 450
East 21.21 feet to a point; thence proceed North 285 feet
to a point on the South right-of-way of Montrose Street;
thence proceed East parallel to the center line of Montrose
Street;35,·feet; thence South 300 feet to the P.O.B.
RESERVING unto the City the perpetual right to enter upon said easement
at any time it may see fit, to construct, maintain and repair water, drainage, sewer,
electric power and other utility facilities over, across, through and under the land
upon which said easement is reserved, with the right to excavate and refill ditches
and/or trenches for the location of said pipeline and/or ditches, and further reserving
the right to move trees, bushes, undergrowth and other obstructions interfering with
the location, construction and maintenance of said pipelines and/or ditches. The City
of Clennont shall be in no way responsible or liable for damages from whatsoever cause
incidental to the exercise of the right herein reserved unto the City.
SECTION 2.
This closing is done pursuant to the authority of the Charter of the City
of Clennont, Lake County, Florida, and the general laws of the State of Florida.

SECTION 3.
This Ordinance shall be posted and published as provided by law and it
shall become law and shall take effect thirty (30) days from the date of its second
reading and final passage.
First Reading this 23rd day of July, A. D. 1974.
Second Reading this 13th day of August, A. D. 1974.
