ORDINANCES N~ 199 ORDINANCE ~O. 59-M AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, REDUCING THE WIDTH OF HIGHLAND AVENUE FROM 80 FEET TO bO FEET FROM THE EASTERN RIGHT-OF-WAY LINE OF EAST AVENUE TO THE CENTER LINE OF GRAND HIGHWAY, ACCORDING TO THE OFFICIAL MAP OF THE CITY OF CLERMONT, RECORDED IN PLAT BOOK 8, PAGES 17 - 23, INCLUSIVE, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA; CLOSING AND PERMANENTLY ABANDONING SAID PORTION OF HIGHLAND AVENUE; PROVIDING FOR THE DISPOSITION OF SAID ABANDONED PORTION OF HIGHLAND AVENUE: PROVIDING AN EFFECTIVE DATE: RROVIDING FOR SEVERABILITY: AND PROVIDING FOR PUBLICATION . WHEREAS: Under date of December 17, 1924, the City Council of the City of Clermont duly passed and ~dopted a certain ordinance reducing the width of Hi gh 1 and Avenue from 80 feet to 60 feet; and WHEREAS, under date of July 7, 1939, the City Council of the City of Clermont duly passed and adoptE!d Ordinance No. 42, confirming said ordinance of December 17, 1924; and WHEREAS, said Ordinance No. 42 did not confirm the reduction of the width of Highland Avenue along the entire length of said Highland Avenue, contrary to the intent of the ordinance of December 17, 1924, thereby causing confusion as to the location of the south right-of-way line of Highland Avenue; THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT: sæTIoÎ~ 1 --.- ._..- Ordinance No. 42 and the Ordinance of December 17, 1924, duly passed by the City Council of the City of Clermont, Lake County, Florida, be and the same are hereby ratified and confirmed. \, SECTION 2 The width of Highland Avenue from the eastern right-of-way line of East Avenue to the center line of Grand Highway, according to the Official Map of the City of Clermont, Recorded in Plat Book 8, Page 17-23 inclusive, Public Records of Lake County, Florida, be and the same is hereby reduced from 80 feet to 60 feet, by moving the South line thereof Northwardly a distance of 20 feet, and the said 20 feet portion of Highland Avenue is hereby closed and permanently abandoned. The said 20 feet portion of Highland Avenue shall inure to the benefi t of the property ownl~rs of the property adjacent to and appurtenant to the Southern edge of said Highland Avenue. SECTION 3 repea led. All Ordinances or parts of ordinances in conflict herewith are hereby SECTION 4 Should any section or part of a section of this Ordinance be declared invalid by any court or competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shan apply. SECTION 5 This Ordinance shall be published as provided by law and it shall become law and shall take effect at: 12:01 A~ M. on the 10th day of October, A. D. 1973. Colonial Dr. ,Orlando, Florida The purpose for requesting the clbsing of this section of the street is that, as platted, the street s~rves no useful purpose and has never been opened. Closing the street will increase the usable area of the adjoining property involved by increasing the actual land area and reducing the setback which is, required from the right-of-way of Lihden Street. We believe that by increasing the usable area of the site that the site would then become larqe enough to make feasible improvement by an apartment complex in accordance with city zoning. A copy of a plat of survey dated February 21, 1969 by C.R. Shewey, Registered Surveyor, is attached to this letter. This survey shows the property involved and that part of Linden Street which is the subject of this request. Lots 1, 2 and 3, Block 87, as represented on the official map of The City of Clermont duly filed and recorded in Plat Book 8, Pages 17 to 23 inclusive, Public Records of Lake County, Florida. Also, all 1:hat portion of said unnamed street which lies west of a line extended due south from the northeast cbrner of Block 87 to the water's edge of Lake Winona and which lies east of a line extended due south from the southwest corner of said Block 87 to a point that intE~rsects the extension of the north right-of-way of Seminole Street and which lies north of the said extended right-of-way line, all according to the official map of 1:he City of Clermont. We respectfully request the closing of Linden Street between the easterly right-of-way of West Avenue and the westerly line of that vacated right-of-way which skirts the northerly side of Lake Winona within the City of Clermont, Florida.
