R-2017-35 • CITY OF CLERMONT RESOLUTION NO. 2017-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, . LAKE COUNTY, FLORIDA, DECLARING CERTAIN CITY. OWNED REAL PROPERTY AS SURPLUS; APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER A QUIT CLAIM DEED TO THAT CERTAIN PROPERTY GENERALLY DESCRIBED AS A 25 FOOT WIDE 275 FOOT LONG STRIP-BETWEEN EAST. MONTROSE STREET AND EAST DESOTO STREET; RESERVING _AND ACCEPTING A 15 FOOT PUBLIC UTILITY EASEMENT ALONG- AND WITHIN THE SUBJECT PROPERTY; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO COMPLETE THE TRANSFER OF THE SUBJECT PROPERTY AND THE ACCEPTANCE OF THE PUBLIC UTILITY EASEMENTS; AND PROVIDING FOR AN EFFECTIVE DATE. j. WHEREAS, by Trustee Deed dated November 13, 2006, the City accepted title at no cost to the City to that certain property generally described as a 25-foot-wide 275-foot-long strip of property between East Montrose Street and East Desoto Street; WHEREAS, the City Council has determined that the subject property is not needed for any public purpose and of no value to the City; and WHEREAS, it is in the best interest of the City of Clermont to transfer the subject property back to the original grantor and/or its assigns and successors and to retain a public utility easement along and within the property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Lake County;Florida, that: SECTION 1. The.City Council does hereby find and determine that the property more particularly described in Exhibit "A" attached hereto and incorporated herein is surplus property and the continued ownership of the property by the City does not serve a public purpose. SECTION 2. In exchange for the granting of a public utility easement as set forth in Exhibit "B" attached hereto; the City Council does hereby approve and authorizes the Mayor to execute the Quit Claim Deeds set forth in Exhibit"A" and to accept the public utility easements. SECTION 3. .
