AN ORDINANCE ABANDONING, CLOSING AND VACATING DESOTO STREET LYING
WEST OF TWELFTH STREET IN THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA:
AND PROVIDING OTHER MATTERS RELATING THERETO.
WHEREAS, the following described street in the City of Clermont,
Lake County, Floorida, and as established and represented on the OFFICIAL
MAP of the CITY OF CLERMONT, filed February 4, 1926 and recorded in
Plat Book 8, pages 17 to 23, inclusive, Public Records of Lake County,
Florida:
DESOTO STREET lying West of Twelfth Street, as
represented on the OFFICIAL MAP of the CITY OF
CLERMONT duly filed on 2/4/26 and recorded in
Plat Book 8, pages 17 to 23, inclusive, of the
Public Records of Lake County, Florida
is no longer needed as a part of the system of streets in said city,
and serves no appreciable service to the city. Said street has never
been opened to the traveling public. It is bounded on the North and
South sides by citrus trees comprising a citrus grove. To open and
maintain same would be an unnecessary expense to the city and would
be without substantial benefit to the public; and,
WHEREAS, there are no municipal services, pavement, water lines
or other improvements, or utilities of any other kind, established in,
on, or over the right of way embraced within the above described street;
and,
WHEREAS, the best interests of the city will be served by the
permanent abandonment, closing and vacating of said street, and the
reversion of the lands within said street to the adjoining and abutting
owners; therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA:
SECTION L. That the following described street in the City of
Clermont, Lake County, Florida, and as pepresented and established on
the OFFICIAL MAP OF THE CITY OF CLERMONT, filed February 4, 1926, and
recorded in Plat Book 8, pages 17 to 23, inclusive, of the Public
Records of Lake County, Florida:
DESOTO STREET lying West of Twelfth Street, as
represented on the OFFICIAL MAP of the CITY OF
CLERMONT duly filed on 2/4/26 and recorded in
Plat Book 8, pages 17 to 23, inclusive, of the
Public Records of Lake County, Florida,
be, and the same is, hereby forever abandoned, closed and vacated.
SECTION II. That all lands lying within the area of the right of
way of the above described street be, and the same are, hereby forever
abandoned and vacated, and shall in equal proportions revert to, and in
fee simple become the property of, the owners of the land adjacent and
abutting thereto; and, the City of Clermont does hereby forever renounce
all rights in any of the lands so described hereinabove as being within
the area or right of way of said street herein abandoned, closed and
vacated, and the public easement therein is hereby forever abrogated.
SECTION III. A copy of the Resolution adopted by this Council on
November 2, 1965; Proof of Publication of the Notice published in South
Lake Press on December 2 and 9, 1965, and this Ordinance certified to
by the Clerk of the City of Clermont shall be recorded in the Public

records of Lake County, Florida, at the expense of the owners of the
property abutting and adjacentt~o said street.
SECTION IV. The Council of this city finds it necessæry to declare
the passage of this Ordinance to be an emergency measure, and, there-
fore, same shall become effective immediately upon its passage.
