R E S O L U T I O N
WHEREAS, on August 6, 1957 Boykin & Elliott Construction
Co., a co-partnership composed of Marvin Boykin and William C.
Elliott, furnished the City of Clermont, a Municipal Corporation
in Lake County, Florida, a completion bond, same being Contract
Bond No. 577412 06114125, issued by the Auto Owners Insurance
Co., Lansing, Michigan, by and through their Agency, George
Eidson Agency, Orlando, Florida, for the completion of the Con-
struction of Disston Avenue and Palm Lane, south of Minnehaha
Avenue and north of Lake Minnehaha Drive, in the City of Clermont;
and,
WIiER:EAS, because of litigation in the nature of a suit for
injunction brought by property owners to enjoin the improvement
of said streets by paving same for which contract had been entered
into between the City of Clermont and the said Boykin & Elliott
Construction Co., it is now found necessary to cancel and re-
lease said bond and said Construction Company therefrom; and,
in the meantime said bond, more particularly above described,
has been lost, destroyed, or otherwise iaisplaced, in the office
of the City Clerk of the City of Clermont; therefore,
BE IT RESOLVED that the City of Clermont, by and through its
City Council, does hereby forever release and discharge the said
Boykin & Elliott Construction Co. as well as the Auto Owners
Insurance Co. under the above described Performance or Contract
Bond, and that there has never been any liability under this
bond and no liability thereunder will ever be claimed or enforced
by the City of Clermont by reason of the issuance of said bond,
or the entering into of said contract with said Boykin & Elliott
Construction Co., and,
BE IT FURTHER RESOLVED that a certified copy of this Resolution
be furnished the Auto Owners Insurance Co., of Lansing,
Michigan, and that the original of this Resolution be spread
upon the Minutes of the City Council of the City of Clermont
when this Resolution is duly adopted by its Council.
