R-59-070'~ D RESOLUTION FOR STREET Irll'ROVErTEl~TT A?~?D SFECIAL ASSESSMENT. WHEREAS, the City Council of the City of Clermont, _ Lake County, Florida, have received petitions from the owners of real property abutting streets hereinafter described and being located within said City, for the improvement of said streets, by the grading, raising, filling, clearing, paving and installation of curbs thereon and adequate drainage for same, and that some petitions are signed by owners represent- ing more than 75f of the assessed valuation of the property abutting said streets, and on other streets not represented by petitions of owners of 75/ of the assessed valuation, if any there be, it is the opinion of the City Council of said City and in accordance with the said petitions that a necessity exists requiring the clearing, grading, raising, filling, drainage, paving and curbing the following described streets in said City: DESOTO STREET -- East Avenue to Disston Avenue MII~'NEOLA AVENUE -- East Avenue to Frince Edward Street DREW AVENUE -- Desoto Street to Minneola Avenue DISSTON AVENUE -- Desoto Street to Pitt Street PRINCE EDWARD S Ti2EET . WHEREAS, in the opinion of the City Council of said City, the property and real estate abutting and adjacent to the street hereinafter mentioned and described will be especially benefited thereby, and the owners of the pro~~er- ty abutting and adjacent thereto will be fully compensated for the cost of said improvement in the enhancement of the values of the real estate and property effected by said _ improvement, and the cost of said property owners in the opinion of the City Council to said city will be equitable and just in proportion to said increased value; WHEREAS, it has heretofore been determined by said City Council and its street committee, that the City using its own crews and equipment, supplemented by additional equipment and independent contractors for paving, could make said improvements on said streets for a sum of money less than costs determined from independent contractors, tr^ereby saving the property owners and the City of Clermont as much as 50~ on the cost thereof and have now made said improve- ments on said streets and have determined by actual cost accounting, a cost of $2.25 per front foot for the abutting property, which costs is more than 50f less than estimated costs thereof by independent contractors, WHEREAS, in the opinion of said Council, the cost of said clearing, grading, raising, filling, paving, curbing and draining said street, will be just to the property owners thereon and is warranted under a necessity which exists for said improvement and that the cost thereof, exclusive of the intersections to be paid by the City, shall be paid by the owners of the property abutting said street in the propor- tions of two-thirds (2/3) (1/3 by the owners of the property on one side of the street and 1/3 by the owners of the pro- perty on the other side} and the remaining one-third (1/3) by the City of Clermont, out of general funds; and, that said owners may pay for same in cash within thirty (30) days of the adoption of this Resolution or may pay same over a period of five (5) years, together with interest on all sums remaining unpaid and due the City, at 6~ per annum, payable annually together with one-fifth (1/5) of the total amount due and as assessed against said property, with said. owners giving to said City, in lieu of the sums of the Certificates of Indebtedness by said City under its Charter authority, their promissory note payable under the same terms and con- ditions, whereby the City may assign said note to some banking institution, or any other person, firm or corporation, -2 - thereby being able to replenlish their general funds so that additional unimproved streets may be constructed, or that ex- isting streets may be otherwi~:e improved in said City; and, that upon the adoption of this Resolution, assessing the cost thereof on a front foot basis, that notice of said assessments be published for at least two weeks in a local newspaper giv- ing said property owners, or other persons, firms or corpor- ations, interested in said property, an opportunity to file their complaints with the City on a time and place to be de- signated by said City in said notice and thereafter said assess- ments, as made or as adjusted upon said complaints, shall then stand confirmed upon the adjournment of said meeting. THEREFORE, BE IT RESOLVED by the City Council of the i City of Clermont, that it is the opiEnion of said council that the cost of grading, raising, filling, paving and installing curbs and drainage on said streets hereinabove described, will be just to the property owners thereon and is warranted under a necessity which exists for said improvement, and that the cost of said improvement shall be paid by the property owners abutting said streets and the City of Clermont, in the proportions of one-third (1/3) each, with the City paying the entire costs of intersections and said costs to be charged on the front foot plan rule and that said costs are now determined to be $2.25 per front foot, however, if, in the application of this rule, in the opinion of said Council, same be unjust or unequal, or result in individual cases in assessment, in excessive or spe- cific benefits received from such improvements, then the Council shall adopt such rule of apportionment, at the hearing to b e held on said assessments, as shall effect a substantial equal- ity between the owners and said city, considering the benefits received by and burdens imposed upon said owners and their re- spective property; and, that said assessments may be paid in cash, on or before thirty (30) days from the adoption of this Resolution, or same may be paid on or before five (5) years -3- from date of this Resolution, if adjusted, together with interest thereon at six (6f) per-cent per annum, payable annually to- gether with at least one-fifth (1/5) of the total assessment due said city, with the privilege of the owners of said property, paying the whole or any amount of said unpaid assessment, at any time thereafter; and, the owners of the respective properties, in lieu of the sums of certificates of indebtedness, by said city, under its Charter authority, will give to the said City, their promissory note, payable under the same terms and condi- tions, thereby enabling the city to assign said notes to any person, firm or corporation, particu larly a banking corporation, whereby said monies received therefrom can be replaced in the General Fund of said city, to be used by said city for the im- provement of other streets or repairs of other streets in said city, but in no way will the assignment of said note, by said city, operate as an assignment of the lien, then owned by the city, and for said improvement. BE IT FURTHER RESOLVED that the City Council of the City of Clermont does hereby assess and levy on and against the several lots and parcels of real property, the respective sums of money set against each lot or parcel thereof for said im- provements, based on the front foot plan and rule of $2.25 per front foot, on each side of said street (which is not in excess of 2/3 of the total cost of said street improvements) as appears by Schedule "A" attached hereto and made a part of this Reso- lution, as if fully and at large set forth herein; and, that further upon the adoption of this Resolution, said Council shall cause to be published in a local newspaper, for at least two con- secutive weeks, a Notice of Assessments, which notice shall set forth the time and place of the meeting of the Council for the purpose of hearing Complaints on said assessments, and a copy thereof shall be mailed to each and every owner of said property (one notice to husband and wife, being sufficient) and said notice shall give the name of. the street upon which the -4- assessment is levied, and the names of the owners, the de- scription of the property, the front footage of said property on the respective street, the unit price per front foot and the total of the assessment and shall further provide that if there be no complaints, the assessments, as originally made, shall stand confirmed at the adjournment of said meeting, ;but if any corrections be made upon Complaint, the assessment, as corrected, shall stand confirmed upon the adjournment of said meeting; and, that, if necessary, said mee ting may be adjourned from day to day until all Complaints, if any, be fully heard and finally resolved; and, BE IT FURTHER RESOLVED that upon the adoption of this Resolution, the Tax Assessor of the City of Clermont shall assess and levy,on and against the several lots and parcels of land, as described in said Schedule "A", the respective sums of money set against each lot or parcel, in the Improvement Lien Book of said City, assigning a number to each Street and shall certify same to the Tax Collector of said City, for the collection thereof, in accordance with the Charter and Ordin- ances of said City. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - ADOPTED by the City Council of the City of Clermont at an adjourned regular meeting held on April 21, 1959, in the City of Clermont. ~;~ty C1er - .. .~ r r r r - r r •.r r r r r ~~ "ter t, Florida r r r w .~ .w r r r ~ ~r r - r A '6961 'L AsIIi 'OE '£Z I!add spuoi,3 'quowaai0 '~[aai0 AgiO NOSN HOf '1Q 'd /s/ 6561 'TZ [!ad'd 'aS.Lda •spuo13 'AqunoO a~[g7 ;o spaoaag oiignd ayq u!
