R-62-005• ~ RESOLUTIONS N o 7 NO. 5 WHEREAS, the City of Clermont through its Council has codified its Charter and Ordinances, and printed and bound same in loose leaf binders and .has arranged with the Municipal Code Corporation for supplements to be printed for insertion on asemi-annual basis; WHEREAS, the Council has found it necessary to establish a policy for the furnishing of a copy to its officers and certain employees whereby records of issuance may be kept to prevent the disappearance of same; and, have de- termined that the value of each volume is $25.00; THEREFORE, BE IT RESOLVED that: 1. The Office of City Clerk is charged with the full responsibility of all records of delivery and sales of copies of the Code and printed supplements to any officer, employee or any other person having a copy of the Code. 2. A current copy of the Code shall be furnished to, and always remain in the offices of the Building Inspector, City Attorney, City Clerk, Municipal Court and Police Department. The City Clerk shall provide for the use of the public in his office during business hours such additional copies as he finds necessary. 3. A copy shall be furnished each officer of the City for use during .his term of office. 4. The City Clerk when authorized by the Mayor shall furnish a copy to the Chief of Police and each member of the Police Department. Special Police shall only have for their use the office copy in the Police Department. 5. The Council may authorize the City Clerk to issue a copy to the Chairman of the Zoning Commission, the Planning Commission, the Board of Adjustment and the Chairman of any Special Committee appointed by the Council • • RESOLUTIONS N °_ 8 NO. 5 who may require a copy during the existence and duties of said committee. 6. The Council may designate from time to time any other employee entitled to have a copy for use in behalf of the City. These shall include the City Engineer, Fire Chief and Health and Sanitation Inspector. 7. The City Clerk may sell to any person, firm or corporation one or more copies of the Code, and he shall keep a record of the name and address of the purchase so that the purchaser may be notified when supplements are available. 8. The Council may authorize the delivery of a copy to the Florida League of Municipalities, the Lake County Law Library, the Cooper Memorial Library, or any other firm or association that has need for a copy whose services are in the interests of the City. When so furnished, the Council may wiave the cost thereof, and when so waived will without cost furnish all supplements to the Code. 9. When authorized by the Council the City Clerk may have additional copies of the Code printed and bound in permanent or loose-leaf binders. Also, the Charter and Index thereto, and any chapter of the Code may be printed in pamphlet form and in either case the Council shall establish the per copy sales price. 10. When the term of office of any officer expires, or is otherwise terminated, or whenever any employee is separated from the City as an employee he shall within five (5) days return to the City Clerk the copy of the Code delivered to him or his office. The City Clerk shall during this period retain any monies due the officer or employee until same is returned. Upon the expiration of this period the Clerk shall deduct the cost of the Code and supplements issued while the Code was in his possession, and if not sufficient to cover the cost shall bill him for • • RESOLUTIONS N ° 9 NO. 5 the balance. This cost shall be deducted after all other necessary charges such as insurance, social security, withholding tax, pension fund, and other authorized deduction .have first been deducted from the monies due him by the City. If later returned the City Clerk may return the amount deducted for the Code and supplements. 11. Every officer, employee, or any other person furnished a copy of the Code by the City, as provided for .hereinabove, is herby made liable and responsible for each copy of the Code and supplements delivered into his pos - session, and upon acceptance thereof, .hereby agrees to insert all supplements into the Code in their respective places, and will pay for the Code and sup- plements if lost, destroyed, or unnecessarily misused by him. The loss, damage or destruction of the binder, or any part of the pages therein shall be equal to a total loss. 12. The price per copy of the Code is hereby set at $25.00. Cost of each supplement will be established by the Council. The Code and supplements will not be sold on any terms, except for cash. Upon the purchase of a copy of the Code all current supplements from the printing of the original Code will be included. The Council may from time to time by Resolution, increase or decrease the price of the Code and its supplements, and amend this Resolution in any manner.
