CITY OF CLERMONT RESOLUTIONS NO . 4 9 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR THE REVISION OF THE CITY'S UTILITY BENEFIT FEES WHEREAS, the City Counc~lcof the City of Clermont, in 1980, adopted City Ordinance 2~~~€-which provides for the establishment of utility benefit fees; and ï.'.3'1-C. WHEREAS, Ordinance -21l-C', as adopted, provides for the proper utilization and accountability of funds generated by the City's utility benefit fees; and WHEREAS, the City Council of the City of Clermont has authorized the expenditure of more than $1,300,000 for the expansion of the City's water and sewer facilities; and WHEREAS, this expansion of the City's water and sewer faciities is necessary due to expected future population growth within the corporate limits of the City of Clermont; and WHEREAS, the City Council of the City of Clermont authorized the evauation and analysis of utility benefit fees imposed in 1980 as to adequacy and propriety; and WHEREAS, this evaluation indicates that a revision in the utility benefit fees is necessary in order to provide sufficient funds to pay for the required expansion of the City's water and sewer facilities; NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ESTABLISH THE FOLLOWING: 1. Utility benefit fees shall be assessed pursuant to Ordinance 2ll-C on the basis of "equivalent residential units", as may be amended periodically by the City Council. For purposes of determining the utility benefit fee for the City of Clermont, an "equivalent residential unit" (ERU) shall mean: a. For residential construction, each separate living unit shall constitute an ERU (i.e., a single family residence shall be 1 ERU, a duplex shall be 2 ERU's, a triplex shall be 3 ERU's, etc.). A mobile home used for residential purposes shall be construed in the same manner. b. For commercial construction, the following shall apply: l. Hotels and Motels - each 2 sleeping units shall constitute 1 ERU. 2. Hospitals and Nursing Homes - each 2 beds shall constitute 1 ERU. 3. Retail Businesses, Professional Offices, Restaurants, Churches, Automotive Service Facilities, Recreation Facilities, Wholesale Business Operations, and other such operations - each 1,500 square feet of enclosed space, or portion thereof, shall constitute 1 ERU. 4. Car Washes - each bay shall constitute 1 ERU. 5. Manufacturing Plants, Heavy Commercial Operations - the number of ERU's shall be determined by the City based upon the value and composition of the waste. 6. The City Council of the City of Clermont reserves the right to establish the applicable ERU for any specific business activity not listed above. . In all cases, consideration shall be given to the number of people using the facility, the size of the facility, and the estimated volume and compo- sition of waste. ~ . e CITY OF CLERMONT RESOLUTIONS NO . 4 9 9 Page -2- 2. Utility benefit fees shall be calculated annually based upon a formula which recovers the total construction cost of the expansion project plus cumulative interest and other fiscal costs of any debt issued by the City for the construction of the project. 3. Any interest earnings on idle funds generated by the collection of utility benefit fees shall be accumulated in a separate fund and shall be utilized at the discretion of the Council, only for additional capital expenditure for further expansion of the project, or for reduction of any debt of the project which may be outstanding. 4. The initial utility benefit fee herein established shall be $1,011 per "equivalent residential unit" (ERU). 5. The effective date of this resolution shall be August 9, 1985.
