Resolution No. 2019-07R CSR CITY OF CLERMONT e of RESOLUTION NO. 2019-07R A RESOLUTION OF THE CITY OF CLERMONT, FLORIDA PROVIDING FOR AUTHORIZATION FOR THE CITY TO MAKE AND PERFECT A GRANT APPLICATION FOR ASSISTANCE UNDER THE FLORIDA BOATING IMPROVEMENT PROGRAM; PROVIDING FOR LEGISLATIVE FINDINGS AND INTENT; PROVIDING FOR IMPLEMENTING ADMINISTRATIVE ACTIONS; PROVIDING FOR A SAVINGS PROVISION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida as follows: SECTION 1. Legislative Findings and Intent 1. The City of Clermont has complied with all requirements and procedures of Florida law in processing and advertising this Resolution. 2. The City of Clermont, Florida, is interested in applying for project and grant approval, receiving and accepting grant funds and carrying out a project for the enjoyment of the citizens of the City of Clermont and the State of Florida which project will have a multiplicity of benefits to the City and the State which project is commonly known as and referred to as the "Clermont Boat Ramp project". 3. Financial assistance from the Florida Boating Improvement Program (FBIP) is essential to the implementation of the development of the Clermont Boat Ramp project. 4. The City of Clermont has developed and maintained a very good relationship with the State of Florida and its agencies over the years and the City and State have worked well together in grant and funding relationships for the benefit of the State of Florida and its public welfare. SECTION 2. Approval of FBIP Grant 1. The City Council of the City of Clermont hereby approves the Florida Boating Improvement Program grants for the Clermont Boat Ramp project. 2. The City Manager is authorized to make application and re-application, as needed, to the State of Florida under the Florida Boating Improvement Program grant program in the amount of$250,000.00 on behalf of the City in order to obtain partial funding from the State of Florida for the Project. 3. The City Manager is authorized to encumber matching funds in the amount of$250,000 on behalf of the City in order to obtain funding, as referenced herein, from the State of Florida for the Clermont Boat Ramp project. 1 • CITY OF CLERMONT CHER NT RESOLUTION NO. 2019-07R Choc,of Charnpcns SECTION 3. Covenants of The City of Clermont The City of Clermont certifies to the State of Florida and agrees that: (a) The City will accept the terms and conditions set forth in Florida Boating Improvement Program Grant Agreement. (b) The City has the ability and intention to finance the cost of the Clermont Boat Ramp project and that the Project will be operated and maintained at the expense of the City for public use. (c) The City will not discriminate against any person on the basis of race, color, religion, disability or national origin in the use of any property or facility acquired or developed pursuant to the Florida Boating Improvement Program grant for the Project and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, Public Law 88-352 (1964) and all other controlling law. The City shall design and construct all facilities relating to the Clermont Boat Ramp project in order to fully comply with all laws, statutes, rules, regulations, codes and ordinances relating to accessibility by disable persons including, but not limited to, the Americans With Disabilities Act. The City of Clermont shall also comply with all other applicable Federal, State and local laws, codes, ordinances, rules, regulations and requirements. (d) The City will maintain adequate financial records on the Clermont Boat Ramp project to substantiate claims for reimbursement and in order to appropriately accomplish any and all pre-audits and post-audits of the expenditure of public funds as well as a performance review of the Project and the achievement of the goals and objectives of the Florida Boating Improvement Program grant program. SECTION 4. Implementing Administrative Actions 1. The Mayor of the City of Clermont is hereby authorized to execute the grant agreements relating to the Florida Boating Improvement Program grant program. 2. The City Manager, or designee, is hereby authorized and directed to implement the provisions of this Resolution by means of such administrative actions as may be deemed appropriate. 3. The City Manager is hereby authorized to expend such City funds as may be necessary to accept and implement the grant under the Florida Boating Improvement Program grant program for the Clermont Boar Ramp project. 2 • CITY OF CLERMONT CHER NT RESOLUTION NO. 2019-07R Chace dUunp ons SECTION 5. Savings The prior actions of the City of Clermont relating to the development of boating facilities and related activities are hereby ratified and affirmed. SECTION 6. Conflicts All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed. SECTION 7. Severability If any section, sentence, phrase, word, or portion of this Resolution is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Resolution not otherwise determined to be invalid, unlawful, or unconstitutional. SECTION 8.
