R-83-430• CITY OF CLERMONT • RESOLUTIONS No. 430 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF 32 TOWN HOUSE UNIT5, TOGETHER WITH IMPROVEMENTS WHICH INCLUDE A POOL AND COMMUNITY CENTER. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at its meeting held June 7, 1983 recommended the approval of the Conditional Use Permit to allow the construction of thirty-two; town house units, together with improvements which include a pool and community center, and the City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1 The application for a Conditional Use Permit to construct thirty-TWO) town house units, together with improvements which include a pool and community building on that part of Tracts 49A and 50A, Lake Highlands Company, according to plat thereof record- edin Plat Book 3, page 38, Public Records of Lake County, Florida, lying East of U.5. Highway 27 in Sec. 19, Twp. 22.5, Rge. 26 E, Lake County, Florida, containing 3.341 acres described as follows: Commencing at the East 4 corner of said Sec. 19, run S O1°00'00" E along the E line of said Sec. 19, a distance of 1317.00 ft.::to.the Eastern extension of the centerline of Desoto St., S 89°39' 00" W along Eastern extension, a distance of 30.00 ft. to the W ROW of Grand Avenue (Highway) for the POB; S 89°39'00" W along the center- line of said Desoto St. (un-opened) a distance of 725 82 ft. to the E ROW of said Hwy. 27, SE'ly along said E'ly ROW, through a curve to the right .having a radius of 5849.65 ft. an arc distance of 118.71 ft.; S 15009'29" E, continuing along said E'ly ROW a distance of 92.20 ft.; N 89039'00" E parallel with said Desoto St., a dis- tance of 683.37 ft. to said W ROW of Grand Ave.; N 01000'00"'W along said W ROW of Grand Ave., also parallel with and 30.00 ft. from said E line of Sec. 19 a distance of 205.92 ft. to the POB.be grant- ed subject to the following conditions: 1. The property must be developed in substantial accordance with the approved site plan. The density of development shall not exceed thirty-two` units. 2. No further expansion of the use or additions to this fac- ility shall be permitted except as approved by another Conditional Use Permit. 3. All applicable rules and regulations shall be met, includ- ing final site plan approval, landscaping, parking, sign regulations and all yard setbacks. 4. The final Certificate of Occupancy cannot be issued .until each of the stated conditions has been met. 5. This permit shall expire if construction has not begun within one year of the date of this CUP. 6. If any of the stated conditions is violated, the applicant understands and agrees that the City Council may revoke this CUP by resolution. 7. All drainage, including overflow devices, must be approved by the Lake County Pollution Control Director and the City Engineer. • CITY OF CLERMONT • RESOLUTIONS No. 430 Page two 8. A buffer strip of trees and hedges must be installed on the north property line, with a sprinkling system to maintain same. 9. A sewer main must be installed to the north property line in accordance with plans approved by the Utilities Dir- ector and the City Engineer. No sewer line shall be in- stalled until the developer performs all engineering work necessary to determine the proper depth of the line for future extension north on Grand Highway to Pitt Street. 10.
