RESOLUTION FOR STREET IMPROVEMENT AND SPECIAL ASSESSr~IEJTS

GJHERLAS, in the opinion of the City Council of the City of Clermont
a necessity exists requiring the clearing, grading, filling, raising,
paving, curbing the streets hereinafter described in said city; and
GdIi;REAS, in the opinion of said Council the real property abutting
and adjacent to said t~iereinafter descri~~ed streets ~•rill ._,e 'especially
benefitted thereby, and the owners of laic'.. abuttin~Y and adjacent property
will be fully compensated for the improvementcosty by the enhancement
of the value of their respective owned real property affected by said
improvement; and, the cost of said improvement will be, in the opinion
of tine City Council, equitable and just in {proportion to said increases:
value; therefore
i3E IT RESOLVED by tine Council of said City teat the following
described streets in said City be cleared, graded, filled, raise and paves.:
Rosewood Drive from Lake Shore Drive to Piinnehaha Ave. (Approyi-
mately 950 feet)
and
BL; IT FURTHER RESOLVED by said Council of said City that it is the
opinion of said Council that the cost of clearing, grading, filling,
raising and paving said street will be equitable and just to the respective
property owners of the real property lying adjacent and abutting said
streets, and is warranted under a necessity which exists and the cost of
said improvements on said street(s) shall be ~~aid as follows: (A) by the
owners of all real property adjoining, contiguous, abutting, adjacent and
wounding on said streets to be cleared, graded, filled, raised and paved
(intersections excluded) under a Special Assessment on all said real
property equal to 2/3rds of the total cost; and (i~) 1/3rd plus the cost
of intersections, if any, to be paid by the City from the general improve-
ment fund. Said Special Assessments shall be due and payable in cash to
the City of Clermont on or before 30 days after said Special Assessments
shall stand approved and confirmed, and thereafter shall bear interest
at 8o per annum payable annually in ~~~,~ equal payments, plus interest,
until fully paid. The trial estimated cost of the above described improve-
ments for tae above described Rosewood Drive is $6,385.00.
BE IT FURT~iER RESOLVED that the plan adopted by said Council to lie.
used for defraying the costs of said improvements as applied to the owners
of the real property ~~~hich abutts and adjoins said respective above
described streets shall be according to the front-foot plan and rule;
unless the application of this plan and rule, in the Council's opinion,
be unjust and unequal, or result in individual cases in assessments in
excess of specific benefits received from such improvements, then the Cit~,~
Council shall adopt such rule of apportionment, as shall effect a substan-
tial equality between said owners, considering the benefits received by
and burdens irlposed on said owners and their respective property.
