WHEREAS, in the opinion of the City Council of the City of Clermont
a necessity exists requiring the clearing, grading, filling, raising,
paving, curbing the streets hereinafter described in said city; and
WHEREAS, in the opinion of said Council the real property abutting
and adjacent to said hereinafter described streets will be especially
benefitted thereby, and the owners of said abutting and adjacent property
will be fully compensated for the improvement costs by the enhancement of
the value of their respective owned real property affected by said improvement;
and, the cost of said improvement will be, in the opinion of the City
Council, equitable and just in proportion to said increased value; therefore
BE IT RESOLVED by the Council of said City that the following
described streets in said City be cleared, graded, filled, raised and paved:
East MinneolaPVenue between Scott Street and Disston Ave.

BE IT FURTHER RESOLVED by said Council of said City that it is the
opinion of said Council that the cost of clearing, grading, filling, raising,
and paving said street will be quitable and just to the respective property
owners of the real property lying adjacent and abutting said street, and is
warranted under a necessity which exists and the cost of said improvements
on said street shall be paid as follows: (A) by the owners of all real
property adjoining, contiguous, abutting, adjacent and bounding on said street
to be cleared, graded, filled, raised and paved (intersections excluded)
under a Special Assessment on all said real property equal to 2/3rds of the
total cost; and (B) 1/3rd plus the cost of intersections, if any, to be
paid by the City from the general improvement fund. Said Special Assessments
shall be due and payable in cash to the City of Clermont on or before 30
days after said Special Assessments shall stand approved and confirmed, or
may be paid in five equal payments plus interest at 8~ per annum until
fully paid. The total estimated cost of the above described improvements
for the above described East Minneola Avenue between Scott Street and
Disston Avenue is $4200.00.
BE IT FURTHER RESOLVED that the plan adopted by said Council to be
used for defraying the costs of said improvements as applied to the owners
of the real property which abutts and adjoins said respective above described
street shall be according to the front-foot plan and rule; unless the appli-
cation of this plan and rule, in the Council's opinion, be unjust and unRnual,
or result in individual cases in assessments in excess of specific ~an~~ts
received from such improvements, then the City Council shall adopt such rule
of apportionment, as shall effect a substantial equality between said owners,
considering the benefits received by and burdens imposed on said owners
and their respective property.

at its meeting held on April 9, 1968.
