R-81-370~ + ~ ~ CITY OF CLERAlONT RESOLUTIONS No. 370 A RESOLUTION OF THE CITY COUNCIL OF THE CITY CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A DEVELOPMENT FOR (38) THIRTY EIGHT SINGLE STORY VILLAS; A PROPOSED SENIOR CITIZEN MULTI-FAMILY COMMUNITY. Whereas, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at its meeting held on July 7, 1981 recommended approval of a Conditional Use Permit to allow the construction of a Development for thirty eight (38) single story villas; a proposed senior citizen multi-family development, as hereinafter set forth by unanimous vote, and the City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE, BE TT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that; SECTION 1. That the application for a Conditional Use Permit to allow the construction of a Development for thirty eight (38) single story villas; a proposed senior citizen multi-family community on the following described property; the undeveloped area south of Carolyn Drive and west of Twelfth Street. All of Block 145, according to Plat of Johnson's Replat of Certain Blocks in the City of Clermont, Lake County, Florida also beginning at the SW corner, Block 145 of said Johnson's Replat, Run then west 300', thence north 330' to the point of beginning, also the south 1/2 of Johnson Street, (closed April 1, 1958) lying north of and adjacent to lots 1, 7, 8 and 9 of said Block 145 of Johnson's Replat, be granted subject to the following conditions: 1. A landscape buffer strip shall be provided on the north and south property lines. 2. The property shall be developed in accordance with the approved site plan. 3. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. • • • • CITY OF CLERAIONT RESOLUTIONS No. 370 Page 2 4. Fire hydrants shall be installed at the developer's expense to facilitate a direct hose lay, not to exceed 500 feet from hydrant to all buildings. 5. Fifty-Seven parking spaces may be allowed, on the condition that if, at a future date, parking problems arise at this location, the owner shall provide up to 76 parking spaces at his expense. The owner agrees that up to 76 spaces will be constructed if requested by a formal resolution of the City Council, and a covenant on the property will be recorded to reflect this fact. 6. Any further construction or expansion must be approved by a Conditional Use Permit. 7. All applicable rules and regulations must be met, including final site plan approval and landscaping. 8. A Certificate of Occupancy for the development shall not be issued until all of the conditions are met. 9. The costs of any alterations to the City sewer lift station made necessary by this development shall be paid by the developer. 10. That the Conditional Use Permit in the Lakeview Hills (_Resolution No. 358) for this development be revoked once FmHA approval is obtained for this project. 11.
