RESOLUTION NO. 247
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, SUPPORTING THE
MUNICIPAL JUDGES ASSOCIATION OF THE STATE OF
FLORIDA IN IMPLEMENTING ARTICLE FIVE OF THE
CONSTITUTION OF THE STATE OF FLORIDA BY ADOPTING
A NEW MUNICIPAL CIRCUIT RIDING JUDICIAL SYSTEM.

WHEREAS, Article Five of the 1968 Constitution of the State of Florida
requires the abolition of all municipal courts by January 3, 1977,;by transferring
all municipal cases to the county court in and for the County in which the municipality
is located; and
WHEREAS, past experience in other municipalities within the State of
Florida has affirmatively shown that the transfer of municipal cases to the county
court creates an impossible hardship upon the defendants, municipalities, county
courts, county clerks, state attorneys, law enforcement agencies, public defenders,
and municipal officials; and
WHEREAS, the expense of transferring and administering municipal court
cases in the county court is so much greater than administering those cases in
the municipal courts of the municipality in which they arise; and
WHEREAS, Justice may be better served by handling municipal court cases
in the local municipalities;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, that:
SECTION 1. The City Council of the City of Clermont does hereby endorse
the Municipal Judges Association of the State of Florida in the Implementation of
Article Five of the 1968 Constitution of the State of Florida, by adopting a new
Municipal Circuit Riding Judicial System, whereby the Municipal Judge, employed by
and paid from State Funds, would hear municipal cases in municipal court with the
same procedures as currently in operation and, whereby, all other court officers would
be employed by the municipality and, whereby, all fines and forfeitures would be
payable to the City Treasuries.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA, that a copy of this Resolution be forwarded to the Municipal Judges

Association, the Police Chief's Association, the City Managers Association, the
State Attorneys Association, other Judges Associations, and to the Local Legislative
Delegation.
