RESOLUTION N0. 257
WHEREAS, Resolution Number 166, adopted by the City Council of the City of
Clermont, Lake County, Florida, on August 25, 1970, authorized the payment of ONE
HUNDRED DOLLARS AND 60/100 ($100.60) each month to Albert M. Johnson, pursuant to
the Clermont Pension Plan, and
WHEREAS, the calculation of the ONE HUNDRED DOLLARS AND 60/100 ($100.60)
monthly payment was in error and the monthly payments should have been ONE HUNDRED
TWENTY-TWO DOLLARS AND NO/100 ($122.00) since January 1, 1971, and
WHEREAS, Section 16-5(L) of the Code of Ordinances of the City of Clermont,
Lake County, Florida, provides for correction and adjustments in cases of an error
in calculation, and
WHEREAS, the City Council has determined that the amount due Albert M. Johnson
as a result of the error in calculation with interest at the rate of 6% per annum
is the sum total of ONE THOUSAND THREE HUNDRED TWENTY-TWO DOLLARS AND 88/100
($1,322.88).
BE IT RESOLVED by the City Council of the
Florida, that the Trust Department of the First
Florida, Trustee for the Clermont Pension Plan,
from the General Employees fund of the Clermont
THOUSAND THREE HUNDRED TWENTY-TWO DOLLARS AND 8
payment to Albert M. Johnson as underpayment of
City of Clermont, Lake County,
National Bank of Leesburg,
be authorized and directed to pay
Pension Plan the sum of ONE
B/100 ($1,322.88) in a lump sum
retirement pension.
BE IT FURTHER RESOLVED that said Trust Department be authorized to pay from
the General Employees fund of the Clermont Pension Plan to the said Albert M.
Johnson the amount of ONE HUNDRED TWENTY-TWO DOLLARS AND NO/100 ($122.00) each
month beginning July 1, 1975, and continuing until his death; and that upon
his death his wife, Lucy Johnson, should she survive him, shall be paid a like
amount on the first of each month until her death.
BE IT FURTHER RESOLVED that Resolution Number 166 is amended to comply with
the matters set forth herein, but in all other respects remains in full force and
effect.
