R-77-292• • RESOLUTIONS N °_ 4 2 9 RESOLUTION NUMBER 292 A Resolution of the City Council of the City of Clermont, Lake County, Florida, supporting the use of County Jail facilities by the City; opposing any additional fees being charged to the City for use of County Jail facilities; supporting a cooperative agreement between Lake County, the Sheriff of Lake County and the City enabling the City to use County Jail facilities for holding municipal prisoners. WHEREAS, the State of Florida has abolished the municipal Court of the City of Clermont and transferred jurisdiction of municipal of- fenses to the County Court, Lake County, Florida, and WHEREAS, the City of Clermont continues to maintain a municipal jail in order to hold persons in violation of municipal ordinances, and WHEREAS, the people of the City of Clermont are taxed at the same ad valorem tax rate as residents of the unincorporated areas, and the City of Clermont should therefore be allowed to use the County Jail without paying fees, assessments, charges, or taxes that are not paid by residents of the unincorporated area, and WHEREAS, any additional fees would be tantamount to double taxation and would be unfair to municipal residents since they would be paying more than residents in unincorporated areas of t}ie County for the same services. NOW, T}{EREFORE, BE IT RESOLVED that the City Council of the City of Clermont hereby supports a cooperative agreement between Lake County, the Sheriff of Lake County and the City of Clermont whereby the City of Clermont would be allowed to house municipal prisoners in the County Jail facilities without additional fees to the City. BE IT FURTF}ER RESOLVED that the County and the Sheriff of Lake County should assume all responsibility for municipal prisoners when municipal prisoners have been transferred to the County Jail facilities, • • RESOLUTIONS N °_ 4 3 0 including medical expenses and ot}ier regular jail expenses. BE IT FURTHER RESOLVED that a copy of this Resolution be presented to the Board of County Commissioners, Lake County, Florida, and Sheriff of Lake County and that the appropriate City officials be authorized to make this presentation and these requests to the County Commission and the Sheriff of Lake County.
