R-89-648 e e No. 648 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A 29 UNIT MULTIFAMILY DEVELOPMENT IN THE R-3 RESIDENTIAL/PROFESSIONAL DISTRICT. WHEREAS, the Planning and Zoning commission of the City of Clermont, Lake County, Florida at a meeting held November 7, 1989, recommended approval of the Conditional Use Permit to allow construction of 29 unit multifamily development in the R-3 Residential Professional District at the following location: Location: Northwest corner of Disston Avenue and Highland Avenue LEGAL DESCRIPTION: The east 301 feet of the south 350 feet of Tract 3, Oakhurst Subdivision The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow con- struction of a 29 unit multifamily development in the R-3 Residential/Professional District be granted subject to the following conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. No further expansion of the use or additions to this facility shall be permitted except as approved by another /Conditional Use Permit. 3. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the city Engineer. These areas must be properly maintained. 4. This property may be used for a 29 unit multifamily development. No other business operation may be conducted from this facility. 5. The final certificate of Occupancy cannot be issued until each of the stated conditions has been met. 6. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 7. Sidewalks will be constructed along Highland Avenue and Disston Avenue. 1 e e RESOLUTION 648 8. Curb and gutter will be required along Highland Avenue and Disston Avenue. 9. Sewer service shall tie into sewer line located at Highland Avenue and Anderson Street. 10. All stormwater will be handled on-site with positive outfall. 11. A joint access agreement with the Sands Apartments will be required before any development permit is issued. 12. One tree per unit per City Tree Ordinance shall be planted on the site. 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
