CITY OF CLERMONT
RESOLUTIONS
NO. 609
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA, CANCELLING A GARBAGE COLLECTION FRANCHISE WITH
AMERICAN REFUSE SERVICES, INC.
WHEREAS, the City of Clermont under Miscellaneous Ordinance 18l-M
granted a Garbage Collection Franchise to American Refuse Services,
Inc.; and
WHEREAS, such Franchise Agreement stated certain conditions that
must be met by the Franchisee; and
WHEREAS, American Refuse Services, Inc. agreed to each and all of
the conditions set forth in the Franchise Agreement; and
WHEREAS, American Refuse Services, Inc. has defaulted under the
following Sections of their Franchise Agreement: Section 7. Require-
ment for a General Liability Insurance Policy and Section 8. Require-
ment for Surety Bond; and
WHEREAS, Section 13. provides for grounds of forfeiture of the
Franchise Agreement upon thirty days written notice from the City; and
WHEREAS, the City has issued the required notice,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Clermont, Lake County, Florida, that the Garbage Collection Franchise
with American Refuse Services, Inc. is hereby cancelled and revoked.
