C1TY OF CLERMONT RESOLUTIONS NO.571 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A 308 SQUARE FOOT STORAGE AREA IN THE C-2 GENERAL COMMERCIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held November 3, 1986, recommended approval of the Conditional Use Permit to allow construction of a 308 square foot storage area in the C-2 General Commercial Zoning District at the following location: Lots 202 and 243, both inclusive, less and except the following the lands: the N 120' of lot 235; N 120' of the E 55.76'of lot 234; S 10' of the E 120'of lot 236; E 120' of lot 237; N 35' of the E 120' of lot 238. ALSO: Lots 200 and 201, less that part thereof lying within the R/O/W of State Road 50. All of the subdivision represented Clermont, pages 17-23 Florida. above lots being in in the City of on the official filed 2-4-26, and inclusive, public Clermont Heights, a Clermont, Fla. as may of the City of recorede in plat Book 8, records of Lake County, ALSO: Lots 141 and 145, inclusive, and Lot 338, Clermont Heights, a subdivision in Clermont as represented on the official map of the City of Clermont filed 2-4-26, Public records of Lake County, Clorida, in Plat Book 8,pages 17 to 23 inclusive, lying N of State Road 50 The City Council deems it advisable in general welfare of the City of Clermont, grant the Conditional Use Permit; the interest of the Lake County, Florida to NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION h The application for a Conditional Use Permit to allow struction of a 40,000 square foot shopping center in the General Commercial Zoning District be granted subject to fol1owing conditions: con- C-2 the CONDITIONS 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inade- quate, the applicant understands and agrees that the City may require additional parking or rescind this Conditonal Use Permit. 3. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. This addition may be used as a storage area only. No other business operation may be conducted from this facility. This Conditional Use Permit is not transferable to any other business use, person or corporation. 6. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 7. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 8. If any of the stated conditions are violated, tha applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 9. Necessary alteration to the south west corner of the parking area shall be made to divert stormwater now leaving the property into the retention area in front of Kentucky Fried Chicken.
