R-87-568• • CITY OF CLERMONT RESOLUTIONS No. 568 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A A THREE (3) RESIDENT, CONGREGATE CARE FACILITY LOCATED IN THE C-2 GENERAL COMMERCIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held October 6, 1987, recommended approval of the Conditional Use Permit to allow the operation of a three (3) resident congregate care facility in the C-2 General Commercial Zoning District at the following location: A parcel of land lying in Gov't Lot 7, Sec. 23, Twp.22S, Rge. 25 E., Lake County, Florida, being more particularly described as follows; Commence at the intersection of the centerline of S.R. 50 and the centerline of S.R. 561 (12th Street) as shown on the State Road Dept. right of way map Section No. 1107-204-106, sheet 16: thence run S.O deg. 20'35" W. along the centerline of said State Road 561 a distance of 181.02' to a point that is N. 0 deg. 20'35" E. a distance of 30' from an intersection of the center line of Broome Street and the said centerline of State Road No. 561; thence N. 89 deg. 18'22" W. parallel with and 30' northerly of the centerline of said Broome Street a distance of 967.87' to the POB; thence continue N 89 deg. 18' 22" W. 25.0'; thence S.O deg 41'38"., 30' to a point on the extension of the centerline of said Broome Street; thence N. 89 deg. 18' 22" W. along said extension of the centerline of Broome Street a distance of 99.70 ft.: thence N.O deg 24' 53" E. a distane of 105.0'; thence S. 89 deg 18" 22", 124.84' more or less, to a point that is N.0 deg. 24'53"W., 75.0' to the POB. Less right of way of Broome Street. Subject to all easements, right of way and restrictions of record. The City of Clermont deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow the operation of three (3) resident, Congregate Care living facility, in the C-2 General Commercial Zoning District be granted subject to the following conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inade- quate, the applicant understands and agrees that the City may require additional parking or rescind this Conditonal Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 1 • C CITY OF CLERMONT RESOLUTIONS RESOLUTION NO. 568 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. This property may be used only as a three resident, congregate care facility. No other business operation may be conducted from this facility. This Conditional Use Permit is not transferable to any other business use, person or corporation. 6. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 7. This permit shall expire if use has not begun within one year of the date of this Conditional Use Permit. 8. If any of the stated conditions are violated, tha applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 9. The building must be inspected by the Lake County Building Inspector and any code violations or deficiencies must be corrected prior to a Certificate of Occupancy being issued. 10. All regulatory agency requirements must be met and letters of approval filed with the City prior to occupancy.
