R-87-561 CITY OF CLERMONT RESOL~JTIONS No. 561 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A DAY CARE CENTER IN THE C-1 LIGHT COMMERCIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held September 1, 1987, recommended approval of the Conditional Use Permit to allow the operation of a Day Care Center in the C-1 Light Commercial Zoning District at the following location: City Block 61, Lots 12 and 13 1158 Fifth Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inade- quate, the applicant understands and agrees that the City may require additional parking or rescind this Conditonal Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval including, four (4) offstreet parking and sign regulations. 5. The portion of the property addressed in the Conditional Use Permit Request may be used only as a Day Care Center. No other business operation may be conducted from this portion of the facility. This Conditional Use Permit is not transferable to any other business use, person or corporation. 6. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 7. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 8. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 9. Protective barrier to be constructed between parking area and playground where parking area abuts playground. CITY OF CLERMONT RESOLUTIONS No. 561 10. Standard sidewalk shall be constructed along Fifth Street and area between sidewalk and curb shall be sodded. City shall install curbing along Fifth Street and radius to Chestnut Street and clear right-of-way. 11. A 6' high solid fence with required landscaping to be constructed on the west, and a 4' high solid fence with required landscaping on the north and east boundaries of the playground. All required landscaping must be served with a permanent irrigation system and must be properly maintained. 12. All other regulatory agency requirements must be met prior to issuance of Certificate of Occupancy. 13. Outside (playground) operation shall only be between the hours of 7: 00 AM and 7:00 PM.
