R-89-641 -- - CITY OF CLERMONT RESOLUTIONS No. 641 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW PROFESSIONAL OFFICE TO OPERATED IN THE R-3-A RESIDENTIAL JPROFESSIONAL DISTRICT. WHEREAS, the Planning and zoning commission of the City of Clermont, Lake County, Fl9rida at a meeting held October 3, 1989, recommended approval of the Conditional Use Permit to allow the operation of a professional office in the R-3-A Residentialj Professional District: LOCATION: 180 East Highland Avenue The City Council deems it advisable in the interest of the general welfare of the city of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow the operation of a professional office in the R-3-A Residentialj Professional District be granted subject to the following conditions: CONDITIONS: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. This property may be used as a PROFESSIONAL OFFICE only. No other business operation may be conducted from this facility. 6. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 7. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 8. An access easement must be granted by the City Council. 9. The applicant will be required to verify building floor area so that exact parking can be calculated. -- .- CITY OF CLERMONT RESOLUTIONS No. 641 10. A five (5) foot wide landscape buffer will be required on the west property line per City Code. 11. All other regulation pertaining to but not limited to signage, tree removal, and stormwater management will be adhered to. 12. When development of property immediately to the east occurs the applicant will be required to participate in the construction of Drew street. 13. If any of the stated conditions are violated, the applicant understands and agrees that the Ci ty Council may revoke this Conditional Use Permit by resolution. 14. In the future if Drew Avenue, adjacent to this property, is opened as a City street, the applicant agrees he or any future property owner shall pay 1/2 of the cost associated with the construction of Drew Avenue. 15. In the event that the city or other utility services should damage the applicant's driveway located on Drew street, the property owner will be soley responsible for repair of the driveway.
