NO. 23-C N~ 50 CODE ORDINANCES AN ORDINANCE AMENDING CHAPTER 3 OF THE CODE OF ORD NANCES OF THE CITY OF CLERMONT, FLORIDA, BY ADDING A SECTION THERETO TO BE DESIGNATED SECTION 3-4, PERTAINING TO THE HOURS OF SALE OF CHOLIC BEVERAGES WITHIN THE CITY OF CLERMONT. IL OF THE CITY OF CLERMONT, BE IT ORDAINED AND ESTABLISHED BY THE CITY LAKE COUNTY, FLORIDA, THAT: Chapter 3 of the Code of Ordinances of the ci y of Clermont, Florida, is hereby amended by adding thereto a new Se tion to be designated Section 3-4 to read as follows: Section 3-4. BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, THAT: Chapter 3 of the Code of Ordinances of the City of Clermont, Florida, is hereby amended by adding thereto a new Section to be designated Section 3-4 to read as follows: Section 3-4. Hours of sale of alcoholic beverages within certain estab- lishments in the City of Clermont, Florida. No alcoholic or intoxicating beverages may be sold, consumed or served or permitted to be sold, consumed or served in any establishment holding a license under the State Beverage Department of Florida between the hours of Midnight and 7 o'clock A. M. the following day or between the hours of Midnight Saturday and 7 o'clock A. M. Monday morning; provided;=however, that restaurants holding licenses under the State Beverage Department of Florida, consisting of 4,000 square feet or more, serving meals and providing for the seating of 200 or more people, may sell, serve and permit to be consumed alcoholic and intoxicating beverages between the hours of 12 Noon and 12 o'clock Midnight on Sunday; provided, further, that such sale, service and consumption of alcoholic and intoxicating beverages shall be permitted only during such time as meals are available for purchase and consumption on the premises; provided, further, that the provisions hereof shall not appl, to the sale of intoxicating or alcoholic beverages in packages for consumption off the premises, or otherwise permit the operation of a package store during such Sunday hours. For the purposes of this Ordinance the provisions relating to square footage, meals and 200 or more seating capacity, are defined as the same appeared and were defined in Chapter 561.20 (2) of the Laws of Florida prior to 1961. Any person violating the prov~s~ons of this Ordinance shall be, upon conviction, subject to the penalties provided in Section 1-8 of Chapter 1 of this Code of Ordinances.
