AMENDMENT NO.1 TO AGREEMENT DATED APRIL 14,2000 PROFESSIONAL ENGINEERING SERVICES EAST SIDE W ASTEW A TER TREATMENT FACILITY EXPANSION General The City of Clermont (Client) and Boyle Engineering Corp. (Boyle) executed an Agreement dated April 14,2000. Under the Agreement, Boyle provided certain professional engineering services related to the expansion of the East Side Wastewater Treatment Facility. The Scope of Services (Exhibit "A") included the Preliminary Design; Final Design and Permitting; Bidding; Construction and Operational phases of the project. Boyle was only authorized by the City to provide services related to Preliminary Design, Final Design and Permitting and Bidding. The purpose of this Amendment No.1 is to authorize Boyle to provide professional engineering services related to the Construction and Operational phases of the project. . Construction Phase Boyle will provide services during construction in accordance with Exhibit "A" of the Agreement and the following: The Duties, Responsibilities and Limitations of Authority of Resident Project Representative have been included in the contract documents for the project as Section 00801 in the specifications. Operational Phase Boyle will provide services during the operational phase in accordance with Exhibit "A" of the Agreement with the exception of the following: One Year Warranty Work as described in Exhibit "A" will not be provided. Additional Design Phase Services Boyle's services during the design phase were based on certain assumptions. Some ofthese assumptions were modified during the design process resulting in increased effort on the part of Boyle. These additional design services are discussed in more detail below: Roads and Drainage: Boyle's scope of services for roadway design was based on reusing drawings that had been produced for the City by another engineering firm. Due to site master planning constraints, the . access road had to be moved rendering the previous plans unusable. Upon reviewing the previous stormwater management design, it was determined that the system would need to be redesigned for compliance with current regulations. The previous stormwater management system design was not reusable. Amendment No.1 East Side WWTF Expansion Page 1 on May 9, 2001 . . . Environmental Resource Permit: Boyle's scope of services assumed the preparation of a letter modification to the City's existing Environmental Resource Permit (ERP). Due to the changes required for the stormwater management system and the eventual expiration of the City's ERP, an application for a new ERP was prepared by Boyle. OperationslParks Storage Buildings: Boyle's scope of services assumed that these two buildings would have a total floor area of 3,000 square feet (sf). The two structures have a total area of 9,360 sf as designed. The building became larger and more complex resulting in increased effort related to architectural services and structural, electrical and mechanical engineering services. Laboratory: Design phase services related to a laboratory were not included in Boyle's Scope of Services, Originally, the City was going to retain the existing operations building with its small laboratory. The City decided to remove the existing building and incorporate a more elaborate lab into the new Operations Building. City staff coordinated the layout and design of the lab with a laboratory casework manufacturer. Boyle provided electrical and mechanical engineering services related to the lab, incorporated the lab layout into the plans and specifications and worked with the City's staff with regard to the lab requirements. Preanoxic Process: Boyle's scope of services assumed that the Preanoxic process (for nitrogen control) would not be included in the project. It was assumed that room on the site would be allocated for this process for construction in the future. During preliminary design, it was decided that it would be . beneficial to include the preanoxic process as part of the project because of the City's past problems with nitrate concentrations in monitoring wells. The design of the preanoxic process resulted in additional services related to civil, structural, process, and electrical engineering. Services Not Included In addition to the services identified in Exhibit "A'\ the following services are not included in this Scope of Services: 1. Materials testing lab services for quality control during construction. Client's Responsibilities In addition to the responsibilities listed in Exhibit "A" of the Agreement, the following items are the responsibility of the Client: 1. Provide the services of a qualified materials testing lab for quality control during construction in accordance with the specifications for the project. 2. Attend monthly construction status meetings and other special meetings that are held during construction. . Amendment No.1 East Side WWTF Expansion Page 2 00 May 9, 2001 . . . . . Period of Service Construction phase services will commence with the Client's notice to proceed and will be completed within 30 days following final completion of the construction contract. Based on the contract time, Boyle's services during the construction phase will conclude 490 days after the start of construction. A draft of the Operations & Maintenance Manuals will be submitted for the City's review 11 months after the start of construction. The final Operations and Maintenance Manuals will be submitted within 30 days of receiving the City's comments on the draft. Record drawings will submitted within 75 days of receiving the contractor's marked up drawings. Compensation Boyle shall be paid in accordance with Section 3 of the Agreement. A labor budget showing the estimated number of hours and associated. fee for the tasks described within the Scope of Services is presented in the Project Budget. An estimated budget for all other project costs, which are expected to include subconsultants, copying costs, mileage, postage, and long-distance telephone calls is also presented in the Project Budget. These budgeted amounts were used to determine the lump sum of $431,171 for the Additional Design, Construction and Operations Phase Services.
