FIRST AMENDMENT TO UTILITY SERVICE AGREEMENT FOR
WASTEWATER BETWEEN
THE CITY OF CLERMONT AND MINNEOLA SCHOOL DEVELOPMENT, LLC
This Addendum is to that certain agreement of January 12, 2016 (the Agreement) between
the CITY OF CLERMONT, FLORIDA, hereinafter referred to as "CITY" and MINNEOLA
SCHOOL DEVELOPMENT, LLC, and hereinafter referred to as "OWNER". The parties, in
exchange for the mutual covenants contained herein and in the Agreement, agree as follows:
1. This Amendment expressly modifies the Agreement and in the event of a conflict,
the terms and conditions of this Amendment shall prevail.
2. The City agrees to provide wastewater service to and on behalf of the property for
an expanded school facility or facilities up to and not to exceed 73,600 square feet. Provided and as
a condition of the expansion of the existing facility or facilities above a total of 53,800 square feet,
the additional expansion area shall be constructed in full compliance with the terms and conditions
of the Agreement, including, but not limited to, compliance with the design and development
review and standards set forth in the Agreement.
3. Section 6 of the Agreement is hereby amended to provide that the Agreement shall
remain in full force an effect unless terminated as provided therein until midnight on January 12,
2026.
4. All other terms and conditions set forth in the Agreement shall remain in full force
and effect and unchanged as agreed to by the parties.
IN WITNESS WHEREOF, the parties hereto have made and executed this Addendum for
the purposes herein expressed on the dates set forth below.
