CITY OF CLERMONT w� RESOLUTION NO.2021-035R A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA OPPOSING ANY COMPREHENSIVE PLAN OR ADDITIONAL LAND USE CHANGES THAT WOULD AUTHORIZE ADDITIONAL MINING OR DESTRUCTIVE DEVELOPMENT WITHIN THE GREEN SWAMP AREA OF CRITICAL STATE CONCERN. PROVIDING FOR CONFLICT, SEVERABILITY, ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND AN EFFECTIVE DATE. WHEREAS, water levels in the Clermont Chain of Lakes and flows within the Palatlakaha River are dependent on discharges from Big and Little Creeks; and, WHEREAS, Big and Little Creeks derive all their flows from the Green Swamp Area of Critical State Concern; and, WHEREAS, flows and water levels within the Clermont Chain and the Palatlakaha River are required to maintain the ecological integrity of the lakes and wetlands; and, WHEREAS, the lakes and connecting waterbodies of the Clermont Chain serve an important economic role in the City by providing recreational opportunities, economic impact and valuable navigation to local businesses and users; and, WHEREAS, the alteration of water recharging upland hills to manmade lakes used in mining and other development results in increased evaporative losses causing decreases in groundwater seepage to the adjoining wetlands and creeks; and, WHEREAS, the combined increases in the alteration of water contributing uplands to manmade waterbodies will collectively contribute to decreased flow in Little and Big Creeks causing impacts to water levels of the Clermont Chain and flows within the Palatlakaha River, and, WHEREAS, such alteration to the water resources of Lake County is in direct conflict with the efforts of the City of Clermont and the Lake County Water Authority to improve water quality, fisheries, and public recreation within South Lake County. WHEREAS, the City of Clermont has identified the Green Swamp Area of Critical State Concern as being within its Joint Planning Area (JPA) and has adopted comprehensive policy plans stating that the City shall coordinate with the agencies that directly oversee the Green Swamp to establish regulations that protect the Green Swamp from the negative impacts of development. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City Council of the City of Clermont, Lake County, Florida as follow: SECTION 1: A. That the above recitals are true and stated as fact and so incorporated herein. E CITY OF CLERMONT RESOLUTION N0.2021- 0 35R B. That maintenance of the ecological function of the lakes and their natural vegetative communities is critical to the protection of Clermont and Lake County's vital water resources, upon which much of the quality of life, recreational opportunity, economic vitality, wildlife habitat, and natural beauty depend. C. That the City of Clermont opposes the adoption of any comprehensive plan changes or additional land use changes that would authorize additional mining or destructive development within the Green Swamp Area of Critical State Concern because of cumulative impacts to wetlands and creeks that provide water to the Clermont Chain of Lakes and the Palatlakaha River. D. That the City of Clermont will cooperate to provide whatever assistance it can in support of the Lake Board of County Commissioners in this effort to protect its water resources. E. That a copy of this Resolution shall be sent to the Lake County Board of County Commissioners. SECTION 2: CONFLICT All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 3: SEVERABILITY If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from the remainder of the Resolution, and the remainder of the Resolution shall continue in full force and effect as if enacted without the invalidated portion, except in cases where such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent of the Resolution as a whole. SECTION 4: ADMINISTRATIVE CORRECTION This Resolution may be re -numbered or re -lettered, and/or corrected for typographical and/or scrivener's errors which do not affect the intent of said resolution, as authorized by the City Manager or designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 5: PUBLICATION AND AN EFFECTIVE DATE This Resolution shall be published as provided by law and it shall become law and shall take effect immediately upon its final passage.
