Ordinance No. 2021-018CLEMOW CITY OF CLERMONT ORDINANCE NO.2021-018 AN ORDINANCE OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, ADOPTING THE SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT FOR THE CITY OF CLERMONT, FLORIDA, PURSUANT TO THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT, CHAPTER 163, PART H, FLORIDA STATUTES; SETTING FORTH THE AUTHORITY FOR ADOPTION OF THE SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT; SETTING FORTH THE PURPOSE AND INTENT OF THE SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT; PROVIDING FOR THE ADOPTION OF THE SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT; ESTABLISHING THE LEGAL STATUS OF THE SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT; PROVIDING FOR CONFLICT, SEVERABILITY, ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND EFFECTIVE DATE. WHEREAS, the Comprehensive Plan of the City of Clermont was adopted by the City of Clermont on June 23, 2009, in accordance with the Local Government Planning and Land Development Regulations Act of 1985, Chapter 163, Part II, Florida Statutes; and WHEREAS, the Comprehensive Plan of the City of Clermont may be amended pursuant to Florida Statute 163.3187; and WHEREAS, the Planning and Zoning Commission and the City Council of the City of Clermont have held public hearings to consider this amendment to the Future Land Use Map of the Comprehensive Plan and considered all written and oral comments, proposals and objections from the general public; and NOW THEREFORE BE IT RESOLVED AND ENACTED, by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. After public hearings held by the City of Clermont Local Planning Agency and the Clermont City Council, the Future Land Use Map of the Comprehensive Plan of the City of Clermont is hereby amended by changing the following described property as shown: LEGAL DESCRIPTION Lots 2, 3, 4 and 5, Block "H", according to the Plat of EDGEWATER BEACH, a Subdivision in Section 25, Township 22 South, Range 26 East, Lake County, Florida, recorded in Plat Book 8, Page 84, Public Records of Lake County, Florida. Lots 1 through 20, inclusive, and Lot 23, Block "A", according to the Plat of EDGEWATER BEACH, a Subdivision in Section 25, Township 22 South, Range 26 East, Lake County, Florida, recorded in Plat Book 8, Page 84, Public Records of Lake County, Florida. That part of First Avenue according to said EDGEWATER BEACH SUBDIVISION lying South of the Southerly Right of Way line of State Road 50; lying North of the Westerly extension of the South line of Lot 17, Block "A", lying West of Block "A", and lying East of Block "A", less and except the Westerly 1/2 lying North of the Easterly extension of the South line of Lot 1, Block "H"; and an unnamed alley according ' CITY OF CLERMONT ORDINANCE NO.2021-018 to said EDGEWATER BEACH SUBDIVISION lying North of Lots 17 through 20, inclusive, Block :A:; lying South of Lots 9 through 16, inclusive, Block "A"; and an unnamed alley according to said EDGEWATER BEACH SUBDIVISION lying South of Lots 1 through 7, Block "A", North of Lot 23, Block "A", lying Westerly of the Westerly right of way line of Lake Blvd. #3-1370, and the extension thereof, less and except any portion of the vacated street known as Madison Street. LOCATION Vacant parcel located on State Road 50 and the corner of Lake Boulevard Alternate Key 3306686 3.12 +/- acres i f rn Lr.a+ II , i CHANGE IN FUTURE LAND USE DESIGNATION: FROM: LAKE COUNTY URBAN LOW TO: CITY OF CLERMONT COMMERCIAL SECTION 2: CONFLICT All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION 3: SEVERABILITY If any portion of this Ordinance is declared invalid, the invalidated portion shall be severed from the remainder of the Ordinance, and the remainder of the Ordinance shall continue in full force and effect as if enacted without the invalidated portion, except in cases where such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent of the Ordinance as a whole. G9' CITY OF CLERMONT ORDINANCE NO.2021-018 SECTION 4: ADMINISTRATIVE CORRECTION This Ordinance may be re -numbered or re -lettered and the correction of typographical and/or scrivener's errors which do not affect the intent may be authorized by the City Manager or designee, without need of public hearing, by filing a corrected or re -codified copy of same with the City Clerk. SECTION 5: PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published as provided by law and it shall become law and shall take effect immediately upon its Second Reading and Final Passage.
