RESOLUTION NO.2022-008R
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT DECLARING SURPLUS APPROXIMATELY .5 +/- ACRES
OF REAL PROPERTY LOCATED AT 332/334 PALM LANE, THE
PROPERTY HAVING BEEN ACQUIRED BY THE CITY THROUGH A
CODE ENFORCEMENT ACTION, AND AUTHORIZING THE SALE
THEREOF TO CAREY HUBBARD FAMILY TRUST FOR THE
PURCHASE PRICE OF $72,000 WITH THE BUYER DEMOLISHING THE
STRUCTURES ON THE PROPERTY AND PAYING ALL CLOSING
COSTS; AND AUTHORIZING THE MAYOR TO EXECUTE THE
PURCHASE AND SALE AGREEMENT AND CITY MANAGER TO
PERFORM ALL ACTS NECESSARY AND APPROPRIATE TO CLOSE
ON THE PROPERTY AS PROVIDED HEREIN.
WHEREAS, the Property that is the subject of this Resolution was acquired by the City through
a code enforcement action in satisfaction of a code enforcement lien;
WHEREAS, there exists on the Property structures that are in need of demolition and Buyer
has agreed to demolish the structures and bring the Property into compliance with applicable City
Codes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont,
Florida, as follows:
SECTION 1.
The City Council of the City of Clermont, Florida does declare surplus the real property located at
the 332/334 Palm Lane consisting of .5 +/- acres and hereby accepts the offer from Carey Family
Trust to purchase the subject property for $72,000.00 and does hereby authorize the Mayor to enter
into the contract attached hereto and incorporated herein as Exhibit "A" and further authorizes the
City Manager to perform all acts necessary and appropriate to close on the property.
SECTION 2.
The Mayor and/or City Manager are specifically authorized to withhold the formal written
agreement upon his or her determination of any matter or factor, hereafter coming to their attention
which may indicate such action is not in the City's best interest, provided that upon such
withholding, the City Manager, with reasonable dispatch, shall present the issue to the City
Council, in session, for review and direction
SECTION 3.
This Resolution shall take effect immediately upon its adoption.
