AGREEMENT
THIS AGREEMENT, by and between AWF, INC., a Florida
corporation, P. o. Box 70042, winter Garden, Florida 34777
("AWF")¡ and CITY OF CLERMONT, a municipal corporation,
1 Westgate Plaza Drive, Clermont, Florida 34711 ("CITY").
In consideration of the mutual covenants and agreements
contained herein together with other good and valuable
considerations, the parties agree as follows:
1.
"AWF" shall sell and "CITY" shall buy that
certain property described in Exhibit "A"
attached hereto and made a part hereof
(representing the North 30 feet of abandoned
railroad right-of-way).
2.
"CITY" shall pay to "AWF" the total sum of
SEVEN THOUSAND FIVE HUNDRED AND NO/100 DOLLARS
($7,500.00) as consideration for the purchase.
"CITY" shall also pay all costs of preparation
and recording the documents of closing.
Ad
valorem taxes shall be prorated at closing.
3.
"CITY" agrees to construct a 6' high chain
link fence of heavy duty quality along the South
boundary of the subject property.
The fence will
be situated on "AWF" property and extend South
30' on each end of the property.
"CITY" also agrees to construct a swale on the

subject property adjacent to the fence for drainage
retention.
"CITY" also agrees to hold harmless
"

the Seller for any normal stormwater run-off from
Seller's property to "CITY'S" property.
5.
This Agreement constitutes the entire agreement
between the parties and shall be binding upon the
parties, their heirs and assigns.

EXHIBIT "A"
The North 30 feet of the following described real property:
A fractional part of the North 1/2, Section 23, Township 22
South, Range 25 East, portions of Johnson's Replat, a subdivision
in the City of Clermont, Florida, dated March 29, 1926, recorded
in Plat Book 8, Page 71, of the Public Records of Lake County,
Florida, and being more particularly described as follows: Begin
at the Northerly corner of Lot 18, Block 115, Southeasterly along
the Northerly boundary of Block 115 to the Northeasterly corner
of Lot 14; thence Northeasterly along a radial line of the curve
forming the Northerly border of Block 115 to the Southwesterly
border of Block 117, Johnson's Replat; thence Northwesterly along
the Southwesterly border of Block 117 to the radial line passing
through the Point of Beginning; thence Southwesterly to the Point
of Beginning.
LESS AND EXCEPT: That fractional part of the former railroad
right-of-way within the Johnson's Replat, City of Clermont,
according to the Plat thereof recorded in plat Book 8, Page 71,
Public Records of Lake County, Florida, lying Southerly of and
adjacent to Block 117 (said boundary of Block 117 being a curve
having a radius of 1168.62 feet, concave to the Northeast):
Begin at iron rod marked 2142 located at the Southwest corner of
Lot 12, Block 117; thence run Westerly along the South line of
Lot 13 a distance of 3.18 feet to Point of Beginning of this
description; from the Point of Beginning run thence Easterly
along said South line of Lots 13 and 12 a chord distance of 10
feet; thence run South 35Q 12' 00" West a distance of 10 feet;
thence run Northwesterly to the Point of Beginning.
