1994-01 .' 8 INTERLOCAL AGREEMENT BETWEEN LAKE COUNTY AND THE CITY OF CLERMONT RELATING TO 8 THE BLOXAM AVENUE EXTENSION CONSTRUCTION PROJECT PROJECT NO. 3-94 .. 8 8 INTERLOCAL AGREEMENT BETWEEN LAKE COUNTY AND THE CITY OF CLERMONT RELATING TO THE BLOXAM AVENUE EXTENSION CONSTRUCTION PROJECT PROJECT NO. 3-94 This is an Interlocal Agreement between LAKE COUNTY, a political subdivision of the state of Florida, its successors and assigns, hereinafter referred to as "COUNTY", through its Board of COUNTY Commissioners; And The City of Clermont, a municipal corporation, pursuant to the laws of the state of Florida, its successors and assigns, hereinafter referred to as "CITY". WITNESSETH: WHEREAS, Chapter 125, Florida statutes, County Government, subsection 125.01(m), provides to counties the authority to provide arterial and other roads; and WHEREAS, Chapter 163, Florida statutes, Intergovernmental Programs, Part I, Miscellaneous Programs, Section 163.01, The Florida Interlocal Cooperation Act of 1969, subsection 163.01(5), provides that a joint exercise of power by public agencies may be made by contract in the form of an interlocal agreement; and WHEREAS, both COUNTY and CITY are "public agencies" within 1 8 8 the meaning of Chapter 163, Florida statutes, Intergovernmental Programs, Part I, section 163.01, the Florida Interlocal Cooperation Act of 1969; and WHEREAS, COUNTY and CITY desire to cooperate in the construction of the Bloxam Avenue Extension in Clermont, hereinafter referred to as "PROJECT". NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises, and covenants hereinafter contained, the parties agree as follows: section 1. Recitals. The above recitals are true and correct and incorporated herein. section 2. Scope of Work. The PROJECT consists of the following construction and improvements: Bloxam Avenue, in the City of Clermont, shall be extended from pitt street northward to Grand Highway. The intersection of Grand Highway with the proposed extension of Bloxam Avenue shall be improved and turn lanes shall be added. The intersection of pitt street with Bloxam Avenue shall be improved and turn lanes shall be added. A right turn deceleration lane shall be constructed on U.s. 27 southbound. Water, Sewer, and Irrigation improvements shall be constructed. CITY has contracted with Springstead Engineering, Inc. of 727 South 14th Street, Leesburg, Florida 32749, to provide construction plans, specifications and required permits for the PROJECT. section 3. Bid Procedure. The projected cost of the PROJECT is Four Hundred Thirty-one Thousand Fifteen Dollars and Ten Cents ($431,015.10). COUNTY previously requested sealed bids 2 ;(' '..' 8 8 pursuant to the Lake County Purchasing Policy for the PROJECT. Upon execution of this Interlocal Agreement, COUNTY shall accept the lump sum bidder best capable in the opinion of COUNTY to complete the PROJECT. section 4. Responsibilities of COUNTY. COUNTY shall be responsible to pay for the Engineering, Permitting, Construction, and Materials of the road improvements, from Road Impact Fee Funds as follows: a. Construction of a new road known as "Bloxam Avenue Extension" to be situated from Pitt street to Grand Highway as identified and described in the approved plans known as Lake County Project No. 3-94, said plans provided to contractor bidding by Lake County with an identified pre-bid date of November 9, 1993, (hereinafter referred to as "APPROVED PLANS"). The APPROVED PLANS are incorporated into this Interlocal Agreement as if fully set forth herein. b. Construction of turn lanes and intersection improvements at the intersection of Bloxam Avenue and Pitt Street according to APPROVED PLANS. c. Construction of turn lanes and intersection improvements at the intersection of Bloxam Avenue and Grand Highway according to APPROVED PLANS. d. Construction of a right turn deceleration lane on the southbound lane of U.s. 27 into Grand Highway according to APPROVED PLANS. e. Construction of drainage improvements according to 3 8 8 APPROVED PLANS. f. COUNTY shall reimburse CITY for those costs incurred by CITY prior to the execution of this Interlocal Agreement so long as said costs were reasonable and necessary and were incurred for the engineering and permitting of roads and drainage directly related to the PROJECT. section s. Responsibilities of CITY. CITY is responsible to pay for the Engineering, Permitting, Construction, and Materials of the following: a. Construction of a water distribution system according to APPROVED PLANS. b. Construction of a sanitary sewer system according to APPROVED PLANS. c. Construction of an irrigation system according to APPROVED PLANS. section 6. Construction and Payment Procedure. It is further agreed by CITY and COUNTY that: a. The approved contractor shall bill COUNTY directly for items related to COUNTY'S portion of work. The approved contractor shall bill CITY directly for items related to CITY'S portion of work. b. CITY is responsible to act as the applicant and to provide all applicable permits required by its portion of the PROJECT. COUNTY shall be the applicant for road and drainage permits. The CITY engineer shall be responsible to ensure that all applicable permits 4 8 8 related to the PROJECT are issued by the appropriate governing agencies, i.e. SJRWMD, FDOT, EPA., prior to construction. c. COUNTY shall provide construction inspection for its portion of the PROJECT. CITY shall provide construction inspection for its portion of the PROJECT. section 7. Duration of Aqreement. The term of this Interlocal Agreement shall be from the date of execution last executed by the party below and shall continue until the proposed Bloxam Avenue Extension Project has been completed. section 8. Notices. (1) All notices, demands, or other writings required to be given or made or sent in this Interlocal Agreement, or which may be given or made or sent, by either party to the other, shall be deemed to have fully given or made or sent when in writing and addressed as follows: CITY COUNTY City Manager City of Clermont Post Office Box 120219 Clermont, Florida 34711 County Manager Lake County Courthouse 315 West Main street Tavares, Florida 32778 .' (2) All notices required, or which may be given hereunder, shall be considered properly given if (1) personally delivered, (2) sent by certified united states mail, return receipt requested, or (3) sent by Federal Express or other equivalent overnight letter delivery company. (3) The effective date of such notices shall be the date personally delivered, or if sent by mail, the date of the 5 8 8 postmark, or if sent by overnight letter delivery company, the date the notice was picked up by the overnight letter delivery company. (4) Parties may designate other parties or addresses to which notice shall be sent by notifying, in writing the other party in a manner designated for the filing of notice hereunder. section 9. No modification or amendment or Amendments. alteration of the terms or conditions contained herein shall be effective unless contained in a written document executed by the parties hereto, with the same formality, and of equal dignity herewith. section 10. Entire Aqreement. This document incorporates and includes all prior negotiations, correspondence, conversations, agreements, or understandings applicable to the matters contained herein and the parties agree that there are no commitments, agreements, or understandings concerning the subject matter of this Interlocal Agreement that are not contained in this document. Accordingly, it is agreed that no deviation from the terms hereof shall be predicated upon any prior representations or agreements whether oral or written. section 11. Severability. In the event any provision of this Interlocal Agreement is held to be unenforceable for any reason, the unenforceability thereof shall not effect the remainder of the Interlocal Agreement which shall remain in full force and effect and enforceable in accordance with its terms and conditions. Trained workers will handle shelter management and family assistance, etc. Your staff/volunteers are not obligated to be pre3ent; however, if they wish to assist, they're welcome. to do so. The premises will be inspected prior to opening and after the shelter has officially closed. The cost of any damages in- curred during use as a shelter will be borne by the American Red Cross. At this time, you may also request reimbursement for any food or supplies used at the request of our staff or volunteers.
