Resolution No. 2023-004Rd CLErc ON-r CITY OF CLERMONT �-� RESOLUTION NO.2023-004R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT REQUESTING THE LAKE COUNTY BOARD OF COUNTY COMMISSIONERS ADOPT NEW TRANSPORTATION IMPACT FEES IN THE SOUTH LAKE TRANSPORTATION IMPACT FEE BOUNDARY AREA; PROVIDING FOR CONFLICT, SEVERABILITY, ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND AN EFFECTIVE DATE. WHEREAS, Lake County first created a South Lake County Fee District in 1985 to collect Transportation Impact Fees on new developments which occurred within the south Lake County fee boundaries, and WHEREAS, the Cities of Clermont, Minneola, Montverde, Groveland, and Mascotte are within the South Lake County Transportation Impact Fee Boundary, and WHEREAS, all the cities in south Lake County and areas of unincorporated south Lake County have seen unprecedented growth over the past 10 years, and WHEREAS, impact fees on new development help lessen the tax burden on existing property owners and businesses and make new development pay their fair share for new infrastructure, and WHEREAS, Lake County hired Benesch to update Lake County's impact fee plan as required by state law, and WHEREAS, the updated impact fee plan shows that the Transportation Impact Fees in the south Lake County boundary area need to be adjusted to help cover the cost of infrastructure caused by planned new developments. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Florida, as follows: The City of Clermont requests that the Lake County Board of County Commissioners adopt new transportation impact fees in the South Lake County Transportation Impact Fee Boundary Area to the 95t percentile of the maximum allowed as demonstrated in the study conducted by Benesch to help all the citizens of south Lake County impacted by the transportation issues that come with new growth. SECTION 1: CONFLICT All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are hereby repealed. CLE ' N, CITY OF CLERMONT 0.d« RESOLUTION NO.2023-004R SECTION 2: SEVERABILITY If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from the remainder of the Resolution, and the remainder of the Resolution shall continue in full force and effect as if enacted without the invalidated portion, except in cases where such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent of the Resolution as a whole. SECTION 3: ADMINISTRATIVE CORRECTION This Resolution may be re -numbered or re -lettered, and/or corrected for typographical and/or scrivener's errors which do not affect the intent of said resolution, as authorized by the City Manager or designee, without need of public hearing, by filing a corrected copy of same with the City Clerk.
