SEWER IMPACT FEE AGREEMENT
This Agreement, by and between CITY OF CLERMONT, a Florida
municipal corporation ("CITY"), and THE OAKS HOMEOWNERS ASSOCIATION,
a Florida corporation ("OAKS"), made and entered into this /&- day of
cO~, 1992.
WHEREAS, CITY OF CLERMONT, is a municipal corporation in Lake
County, Florida, providing sanitary sewage treatment and disposal, and
WHEREAS, THE OAKS HOMEOWNERS ASSOCIATION is a Florida corporation
serving as a homeowners association provided for in the Declaration of
Condominium of The Oaks Condominium, and
WHEREAS, the "CITY" and the "OAKS" have entered into that certain
Interlocal Agreement wherein "CITY" is providing sewage treatment and
disposal services for "OAKS", and
WHEREAS, said Interlocal Agreement provides that "OAKS" pay to
"CITY" the sewer impact fee.
NOW THEREFORE, the parties agree that "OAKS" may pay to "CITY" the
sewer impact fee as follows:
1.
Payment in full as prescribed by City of Clermont Sewer Impact
Fee Ordinance.
2.
Payment in five "5" equal annual installments together with
interest on the unpaid balance at a rate equal to the average of
previous twelve (12) months interest rate paid by the State Board of
Administration plus two hundred basis points.
The rate will be calculated December 1 of each year.
