STIPULATION AGREEMENT
This Stipulation Agreement (the IIAgreementll) is. made by and
between Lake Hills Utilities, Inc., a Florida corporation, whose
mailing address

Longwood,
Florida 32791
(IILake Hillsll) and the City of Clermont, whose mailing address is
P. O. Box 120219, Clermont, Florida 34712-0219 (the IICity").
WITNESSETH:
WHEREAS,
Lake Hills is in the business of providing water
utility service in Lake County, Florida; and
WHEREAS, Lake Hills submitted an application to the Florida
Public Service Commission to expand its service area pursuant to
that certain application for amendment of certificate no. 512-W
(the" Application,lI ): and
WHEREAS, the Application was docketed by the Florida Public
Service Commission on November 18, 1991 under docket no. 911139-
WU: and
WHEREAS,
by
letter
dated
December 17,
1~91,
the
City
notified the Florida Public Service Commission of its objection
to the Application: and
WHEREAS,
the City has agreed to withdraw its objection to
the Application if Lake Hills agrees to amend the Application,
and Lake Hills agrees to amend the Application if the City agrees
to withdraw its objection to the Application; and
WHEREAS, the purpose of this Agreement is to set forth the
terms under which the City shall withdraw its objection to the
Application and Lake Hills shall modify the Application.
NOW, THEREFORE,
for and in consideration of the sum of TEN
DOLLARS ($10.00) in hand paid by each party hereto to the other,
and other good and valuable consideration not set forth herein
but the receipt and sufficiency of which is hereby acknowledged,
the parties hereto hereby agree as follows:

Lake Hills sh~ll amend the Application to expand its
service
area
only
to
that
certain
property
described
on
Exhibit "A" attached hereto.

By virtue of its execution of this Agreement, the City
agrees
that
its
objection
to
the
Application
shall
be
automatically withdrawn
for all
purposes without
any further
notice or confirmation of such withdrawal at such time as Lake
Hills
files
with
the
Florida
Public
Service
Commission
an
amendment to the Application to limit expansion of its service
area to that certain property described on Exhibit" A" attached
hereto.
Notwithstanding the
foregoing,
upon request by Lake
Hills,
the
City
shall
execute
such
reasonable
notice
or
confirmation as may be required by the Florida Public Service
Commission to evidence the City's withdrawal of its objection to
the Application.
IN WITNESS WHEREOF,
the parties hereto have executed this
Agreement in a manner and form sufficient to bind them as of the
dates set forth below.
