INTERLOCAL AGREEMENT

This Interlocal Agreement entered into this ~ day of

municipal corporation, Lake County, Florida, and the City of Clermont,
Florida, a municipal corporation, Lake County, Florida.
RECITALS
WHEREAS, Montverde owns and maintains a municipal fire and rescue
department, and
WHEREAS, Montverde needs assistance from the City of Clermont to
dispatch 911 emergency calls for fire, and
WHEREAS, the City of Clermont will make available its personnel to
dispatch fire calls of the Town of Montverde under the terms outlined
below.
Now, therefore, based upon their mutual covenants and promises, the
parties agree as follows:
1.
The City of Clermont will provide dispatching services for all
911 fire calls of the Town of Montverde.
For purposes of this
Agreement, the term "dispatching services", shall mean:
a.
Receiving all 911 fire calls of the Town of Montverde,
as relayed from the central Lake County 911 center, and
b.
Dispatching the calls promptly to the Town of Montverde
or its designated representative (such designation shall
be in writing).
It is understood and agreed that the City
of Clermont fire calls shall retain first priority.
2.
All radio and communications equipment needed to implement this
Agreement shall be provided by the Town of Montverde.
All dispatch
personnel
shall
be
employees of the City of Clermont and shall remain

under the exclusive control of the City of Clermont.
All radio
communications equipment needed to implement this Agreement shall be
the property of the Town of Montverde, unless otherwise agreed in
writing by both parties.
3.
This Agreement shall include dispatching for Montverde 911
fire calls only.
Excluded from this Agreement is any dispatching calls
for police assistance or rescue.
4.
The Town of Montverde will, at its expense, furnish all
equipment, including telephone lines, needed to implement this
Agreement.
Additionally, the Town of. Montverde shall pay all ordinary
and necessary out-of-pocket expenses incurred by the City of Clermont
to modify or upgrade its radio equipment, provided however, the City
of Clermont will get the prior approval of the Mayor of the Town of
Montverde before incurring any cost or expense in excess of ONE HUNDRED
AND NO/lOO DOLLARS ($100.00).
The Town of Montverde shall pay any
ongoing costs, i.e., telephone charges, maintenance agreements and
repairs.
5.
The Town of Montverde shall pay the City of Clermont the sum
of FIFTY AND NO/lOO DOLLARS ($50.00) per month for dispatching services
provided under this Agreement, payable on or before the fifteenth (15th)
of each month.
6.
The Town of Montverde, for itself, and its officers, agents,
and successors, shall indemnify and hold harmless the City of Clermont
(and its councilpersons, officers, agents, and employees) from any and
all claims, demands, and causes of action asserted against the City of
Clermont by virtue of this Agreement.
The City of Clermont shall be
named as an additional insured on the Town of Montverde's liability

insurance policy.
7.
The terms of this Agreement shall be two (2) years, commencing
on the date this Agreement is approved by each municipality, or if the
Agreement is approved on different dates, the date of last approval, and
may be terminated without cause by either party upon sixty (60) days
written notice.
