THIS AGREEMENT is entered into this lath day of April
1991, between the CITY OF CLERMONT, Florida, hereinafter referred to as
CLERMONT, and J. B. HAUSEN COMPANY, hereinafter referred to as HAUSEN.
WHEREAS, HAUSEN is the owner of the following described real
property in Clermont, Lake County, Florida:
Lot 8, less the East 31 feet thereof and all of Lot 10,
of Block 77, in the City of Clermont, as recorded in Plat
Book 8, Page 17, of the Public Records of Lake County,
Florida.
and
WHEREAS, an office building recently was constructed on the
property and a difference of opinion arose as to the proper elevation of
the office parking area and the actual construction may result in
flooding of the parking area from city street runoff,
and
WHEREAS, HAUSEN is satisfied with the elevation of the parking area
and the actual construction of the parking area and is willing to accept
the same and release CLERMONT from any further liability for the
construction of the parking area and for any future damage by street
runoff.
NOW, THEREFORE, the parties hereto agree as follows:
1.
CLERMONT, by signing this Agreement, hereby accepts the
elevation and construction of the parking area as described above.
2.
HAUSEN, by signing this Agreement, accepts the construction
of the parking area "as is" and hereby releases CLERMONT from, and
agrees to hold harmless from, any past, present, or future
responsibility for any damages concerning the parking area or any
damages associated with street runoff or storm water runoff.
3.
This Agreement is binding upon the parties hereto, their
heirs and assigns, invitees, and guests.
4.
This Agreement shall be recorded in the Public Records of Lake
County, Florida, and the provisions herein shall run with the land.
