INTERLOCAL AGREEMENT BETWEEN
THE CITY OF MASCOTTE AND THE CITY OF CLERMONT
FOR DISPOSAL OF YARD TRASH FOR COMPOSTING

This Agreement is entered into by and between the City of
Mascotte and the City of Clermont, both being municipal
corporations of the state of Florida.
WHEREAS, the state of Florida adopted the 1988 Solid Waste
Management Act, codified in Chapter 403, Florida Statutes, which
requires local governments to reduce their solid waste streams, and
WHEREAS, it is in the best interest of the citizens of the
cities of Mascotte and Clermont to work together in the reduction
of the solid waste stream.
NOW, THEREFORE, in consideration of the mutual benefits
derived, the City of Mascotte and the City of Clermont agree as
follows:

SECTION 3.
The City of Mascotte shall provide and operate
a permitted site for the acceptance of
compostable material.
The compost site shall be accessible five (5)
days per week, except on scheduled holidays or
for reasons beyond the control of the City.
The City of Mascotte agrees to provide and
operate a chipper or mulcher on site for
grinding of certain materials for composting.
The site shall be operated in a safe manner as
to minimize any safety hazards.
The City of Mascotte agrees to accept
compostable material, defined as grass
clippings, leaves, shrubbery clippings,
prunings, limbs and other compostable yard
trash from the City of Clermont for the term
of this agreement.
The City of Mascotte may reject any materials
found not of the type acceptable for
composting, as agreed to herein.
The City of Clermont agrees to deliver only
yard trash as herein defined to the site.
All material shall be stockpiled
designated by the City of Mascotte.

Materials shall be separated by the City of
Clermont as to those needing to be chipped and
other readily compostable material.
CONSIDERATION
The City of Clermont agrees to pay the City of Mascotte
the sum of $10,000 in return for considerations and
agreements outlined within this agreement.
SECTION 4.
TERM
The term of this agreement shall be one year, commencing
February 1, 1991.

SECTION 5.
MODIFICATIONS
This Interlocal Agreement may be modified at any time by
mutual written consent.
SECTION 6.
INDEMNIFICATION
The City of Mascotte and the City of Clermont
indemnify, save and hold harmless each other
liabilities, claims or damages of any kind
negligent acts or omissions arising out of or
to this Interlocal Agreement.
