Resolution No. 2023-044Rdy CLLER ' NT CITY OF CLERMONT 0,,C RESOLUTION NO.2023-044R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT OF LAKE COUNTY, FLORIDA APPROVING AN INVENTORY LIST OF MUNICIPALLY OWNED PROPERTY THAT IS APPROPRIATE FOR USE AS AFFORDABLE HOUSING PURSUANT TO SECTION 166.0451, FLORIDA STATUTES, PROVIDING FOR CONFLICT, SEVERABILITY, ADMINISTRATIVE CORRECTION OF SCRIVENERS ERROR, PUBLICATION AND AN EFFECTIVE DATE. WHEREAS, Section 166.0451, Florida Statutes requires that municipalities in the State of Florida prepare an inventory list of all real property within its jurisdiction to which the City holds fee simple title that is appropriate for use as affordable housing; and WHEREAS, the inventory list must include the address and legal description of the property and specify whether the property is vacant or improved. The City Council must then review the inventory list at a public hearing and revise the inventory if necessary. Following the public hearing, the City Council must adopt a Resolution that includes the inventory list of the property; and WHEREAS, City of Clermont staff has reviewed the inventory of City -owned property, and has determined that the City does own property that is appropriate for use as affordable housing; and WHEREAS, pursuant to review of the inventory of City -owned property by City of Clermont staff, the City Council accepts the review, and hereby finds that the adoption of this Resolution is in conformance with the requirements of Section 166.0451, Florida Statutes; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Clermont, as follows: SECTION 1: The City Council of the City of Clermont finds and declares that adoption of this Resolution is necessary, appropriate, and in the public interest of the citizens of the City of Clermont. SECTION 2: The following inventory list of City -owned property that is appropriate for use as affordable housing is hereby adopted pursuant to Section 166.0451: Alternate Key # 1438373 - Max Hooks Road 1 d CITY OF CLERMONT h C ( RESOLUTION NO.2023-044R SECTION 3: CONFLICT All resolutions or parts of resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 4: SEVERABILITY If any portion of this Resolution is declared invalid, the invalidated portion shall be severed from the remainder of the Resolution, and the remainder of the Resolution shall continue in full force and effect as if enacted without the invalidated portion, except in cases where such continued validity of the remainder would clearly and without doubt contradict or frustrate the intent of the Resolution as a whole. SECTION 5: ADMINISTRATIVE CORRECTION This Resolution may be re -numbered or re -lettered, and/or corrected for typographical and/or scrivener's errors which do not affect the intent of said resolution, as authorized by the City Manager or designee, without need of public hearing, by filing a corrected copy of same with the City Clerk.
