This agreement

Clermont
hereinafter referred to as the IICityll and Lake County, a political
subdivision of the State of Florida, hereinafter referred to as the
II County II .
WHEREAS, the County and the City both recognize the value of
quality, leisure activities for citizens of all ages residing in
the City and the County respectively, and
the Ci ty has
in place a mechanism for providing
WHEREAS,
quality, leisure activities, and
the County is desirous of providing these leisure
WHEREAS,
activities for citizens living throughout the County.
NOW, THEREFORE, to promote the health, safety and welfare of
the City and the County respectively, the City and County agrees
as follows:

The County will provide to the City funding as follows:
TEN THOUSAND TWO HUNDRED FORTY EIGHT DOLLARS AND
TWENTY FIVE CENTS ($10,248.25)
Said funding shall be used exclusively for:
1989 Summer Recreation Program
Jaycee Beach Operation
3.
The City agrees to provide to the County a full
accounting of the expenditures of said funds and further
agrees that the funds will be used exclusively for the
purpose or purposes enumerated in this agreement.
4.
If the funds allocated pursuant to this agreement are not
expended by the City by the end of FY 89-90
(September 30, 1990) for the purposes enumerated herein,
said funds will be immediately returned to the County.
5.
Nothing in this agreement should be construed to indicate
an agreement to provide ongoing funding for any purpose.
6.
The City is solely responsible for the design,
construction, operation, program, program content,
program operation and supervision of program, and
supervision of facility.

7.
The Ci ty agrees to fully indemnify the County for all
costs including, but not limited to, court costs, legal
fees, witness fees, judgement costs, interest, relating
to any cause of action arising out of the operation of
this agreement, or the use of the funds from this
agreement for any program.
8.
In the event that there is a user fee for the specific
program receiving these said funds, the City agrees to
charge the same fee to all County residents irregardless
of where they reside within the County.
9.
This agreement shall become effective immediately
the signing by all appropriate parties.
