AGREEt 1ENT
THIS AGRæ1ENl', by and between the CITY' OF Cl.EPM)Nr. Lake County. Florida, a
lIDJIlÍcipal corporation organized and existing tmder the laws of the State of
Florida, hereinafter referred to as "CITY"'. and lAVERNE u. RIJONA, hereinafter
referred to as "RlJONA".
The parties agree as follows:
1.
"RIJON:N' is the fee simple title owner of the real property described
in Exhibit "A" attached hereto.
2.
"CIIT' maintains a water service line over and across the said real
property, which line has existed for rnny years and serves property
in the area with t:.1-}e capability of also serving the subj ect property.

however' 'CI'IY' I does not possess a w-ritten easement for said water
line.
3.
"CI'IY" grants to "RIJONA" the right to construct a pool deck aver
the subject water service line on the condition the water service line
is not dam3.ged.
4.
"CITY'" shall maintain and service the water service line. but in the
event the water service line needs substantial repair such that the
said pool deck ~d have to be rerooved, "CITY'" agrees to abandon the
said water service line.
5.
"RlJONA" grants to "CITY" the right of ingress and egress to maintain
the water service line, except for any work that might damage the pool
deck, and "CI'IY" agrees to indemnify and hold harmless "RIJONA" for any

damage to the property, including the pool deck.
This agreanent shall be binding upon the heirs, assigns and shall be
construed to r...m with the land.
