AN ORDINANCE OF THE CITY OF CLERMONT AMENDING
CHAPTER 22, "CEMETERIES", OF THE CITY CODE BY AMENDING
SECTION 22-3, "RULES, REGULATIONS AND RESTRICTIONS", TO
REMOVE THE REQUIREMENT THAT OAK HILL CEMETERY BE
RESTRICTED TO A LAWN MEMORIAL TYPE CEMETERY;
PROVIDING FOR SEVERABILITY, CONFLICT, EFFECTIVE DATE
AND CODIFICATION.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CLERMONT, FLORIDA, as follows:
Section 1. That Section 22-3, "Rules, regulations and restrictions" of the Code of
Ordinances, City of Clermont, Florida is amended to read as follows:
Sec. 22-3. Rules, regulations and restrictions.
The council shall by resolution establish rules, regulations and restrictions for the
use of the cemetery relating to:
(1) Subdividing the cemetery into lots, blocks, streets, walkways, and recording the plats
thereof;
(2) Capacity of each lot;
• (3) Location of graves;
(4) Type of plantings as well as the size of and materials in monuments and markers that
will be permitted for the proper and most attractive development of the cemetery.
(5) Use of certain lots for single burials and burials of paupers;
(6) Location of and plans and specifications for all structures of any kind for the
interment of human bodies or cremated remains; and
(7) All other matters for the orderly use and development of the cemetery.
Section 2. Severability. It is declared to be the intent of the City Council that, if any
section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held
invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portions hereof.
Section 3. Conflict. Any portion of the Code of Ordinances, City of Clermont, Florida
or any ordinance or part thereof in conflict with this ordinance is hereby repealed to the extent of
such conflict.
Section 4. Effective Date. This ordinance shall be published as provided by law and
shall take effect immediately upon its Second Reading and Final Passage.
Section 5. Codification. The provisions of Section 1 of this Ordinance shall be

codified as and become and be made a part of the Code of Ordinances of the City of Clermont.
The Sections of this Ordinance may be renumbered or re-lettered to accomplish such intention
• and the word "Ordinance", or similar words, may be changed to "Section," "Article", or other
appropriate words. The Code codifier is granted liberal authority to codify the provisions of this
Ordinance.
