O-353-CCITY OF CLERMONT ORDINANCE N0.353-C AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLERMONT AMENDING CHAPTER 2, "ADMINISTRATION", OF THE CITY CODE BY AMENDING SECTION 2-212, "COUNSEL NAMED" PROVIDING THAT THE CITY ATTORNEY SHALL REPRESENT THE CITY STAFF BEFORE THE CODE ENFORCEMENT BOARD, PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICT AND EFFECTIVE DATE. WHEREAS, Florida Statute Section 162.05, provides that the City Attorney for a local government that creates a Code Enforcement Board shall represent the Code Enforcement Board or the City; but not both; and WHEREAS, the Clermont City Council has determined that in the best interest of the efficient and effective enforcement of city codes, that the City Attorney should provide legal services to the City and not represent the Code Enforcement Board. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA, as follows: Section 1. Section 2-212, "Counsel Named" of the Code of Ordinances, City of Clernont, Florida, is amended to read as follows: Section 2-212. Counsel Named The City Attorney shall serve as counsel to the City in all matters before the Code Enforcement Board. Section 2. Severability. It is declared to be the intent of the City Council that, if any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 3. Conflict. Any portion of the Code of Ordinances, City of Clermont, Florida or any ordinance or part thereof in conflict with this ordinance is hereby repealed to the extent of such conflict. Section 4. Codification. The text of Section 1 of this ordinance shall be codified as a part of the Clermont City Code. The codifier is authorized to make editorial changes not effecting the substance of this ordinance by the substitution of "article" for "ordinance", "section" for "paragraph", or otherwise to take such editorial license. 1 Section 4. Effective Date. This ordinance shall take effect April 1, 2007. PASSED AND ORDAINED BY the City Council of the City of Clermont, Lake County, Florida on this 9th day of January 2007.
