R-06-1479City of Clermont • RESOLUTION NO. 1479 A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA REGARDING THE UPPER OCKLAWAHA RIVER BASIN MANAGEMENT ACTION PLAN; RESOLVING THAT THE CITY COUNCIL SUPPORTS THE CONTINUED UPDATE AND FINALIZATION OF THE PLAN AND THE IMPLEMENTATION OF THE PLAN; RESOLVING THAT THE CITY SHALL SEEK APPROVALS AND FUNDING TO ACCOMPLISH THE CITY'S RESPONSIBILITIES UNDER THE PLAN; RESOLVING THAT THE CITY ENDORSES THE CONTINUATION OF A COORDINATED AND COMPREHENSIVE WATERSHED MANAGEMENT APPROACH TO ADDRESS AND ACHIEVE DEP-ADOPTED TOTAL MAXIMUM DAILY LOADS FOR THE UPPER OCKLAWAHA RIVER BASIN; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SIGN OFF ON THE PLAN; PROVIDING FOR CONFLICTING RESOLUTIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Clermont understands that the Upper Ocklawaha River Basin Management Action Plan (BMAP) is being developed through a collaborative effort between the Florida Department of Environmental Protection (DEP), local governments m the Upper Ocklawaha River Basin, other local, state, and regional agencies, and private and public interests to identify cost-effective actions that will be undertaken to achieve the Total Maximum Daily Loads (TMDLs) adopted by DEP for the Upper Ocklawaha River Basin; and WHEREAS, the City Council of the City of Clermont acknowledges that representatives from the City of Clermont have participated in the development of the BMAP and the management actions contained within it; and WHEREAS, on April 25, 2006, the City Council of the City of Clermont received a briefing on the contents of the BMAP to date, and understands that, although there will be some revisions to the plan before it is adopted by order of the DEP Secretary, the revisions are not expected to significantly change any fiscal or policy impacts to the City of Clermont. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that; Section 1. The City Council supports the continued development and finalization of the Upper Ocklawaha Basin Management Action Plan, with the participation of representatives of the City of Clermont. • Section 2. The City Council supports the implementation of the BMAP, and will seek . the necessary approvals and funding to carry out the management actions for which the City of Clermont has responsibility in the plan. Section 3. 'The City Council will give careful consideration to recommendations for further action contained in the BMAP. Section 4. The City Council supports staff participation in: the coordinated tracking of BMAP implementation; in follow-up with DEP and other stakeholders; and revising the plan as necessary to ensure the management actions are effective in meeting the TMDLs. Section 5. The City Council Endorses the continuation of a coordinated and comprehensive watershed management approach to address and achieve DEP-adopted Total Maximum Daily Loads for the Upper Ocklawaha River Basin. Section 6. 'The City Council authorizes the City Manager or his designee to represent the City Council in reviewing and signing off on the final BMAP, preliminary to its adoption by DEP. However, if staff determines that revisions to the BMAP after the date of this resolution significantly change any fiscal or policy impacts to the City of Clermont, staff will brief the City Council and request further direction before signing off on the plan. • Section 7. All resolutions, rules, regulations, restrictions or policies of the City of Clermont in conflict herewith are hereby repealed to the extent of the conflict. Section 8.
