Subject: Revised Professional Services for Design of a Telemetry System for the City's Wastewater System and Reuse Ponds Tt HAI #01.0156.000 Dear Ms. Richardson: Per our correspondence on Thursday September l4`", Tetra Tech (Tt HAI) is pleased to provide the City of Clermont with this revised proposal for professional services necessary to complete design, bidding, and construction management services for the Telemetry System project. For clarification we are providing you with this updated Scope of Services, which includes all work required to complete the project. • Bacltground This project became dormant in May of 2003 when twelve (12) of the City's oldest lift stations were found to require electrical system improvements in order to incorporate the proposed telemetry system. Electrical improvements to these lift stations are currently underway. To ensure the telemetry design is complete and the project is ready to bid when the lift station electrical system improvements are complete, Tt HAI would like to resume the design process immediately. Various items have changed since the original scope of services was signed on October 11"', 2001. Approximately eight (8) additional lift stations have been added to the design. All telemetry originally proposed for the water system will no longer be included in this project. The water system telemetry will be added to other current or proposed City projects. Approximately 75 percent design, including the specifications and drawings, were completed prior to placing the project on hold, therefore these documents will be updated to complete design of the project. As discussed in our meeting, based on the lapse of time since the project was placed on hold and changes to the scope of work, there are additional costs for professional services associated with the completion of the project. October 2, 2006 Page 2 of 6 SCOPE OF SERVICES • The general work included within this scope of services is for the completion of design, bidding, and general construction services associated with a Telemetry System to monitor the City's wastewater lift stations. The project includes forty eight (48) original lift stations along with eight (8} new lift stations that require telemetry, and will be included in this project. Before the Telemetry project was placed on hold, the radio survey licensing and permitting for the project was completed, however a new radio survey must be completed for the additional eight (8) lift stations. It is Tt HAI's understanding that the City desires to have two (2) separate computers, one (1) located at the Eastern WWTP, and one (1) at the Public Works office. The computers shall be configured such that each computer can be utilized to monitor the wastewater lift stations, therefore providing For system redundancy and reliability. A. Final Design: The completion of design of the telemetry system will result in the appropriate number of bid documents, engineering drawings and specifications. Tt HAI will provide three (3) copies of the documents to the City for review at the 90% and l00% level prior to bidding. In addition, a construction cost estimate will accompany the final design documents. Tt HAI or designated subconsultant shall attend one (1) coordination/review meeting with the City to discuss review comments. The tasks to be completed during this phase are summarized below and will be based upon a non- proprietary system as agreed to previously. (1) Prepare construction drawings and specifications for the telemetry system, reuse system and associated controls from the existing documents. Documents shall include drawings and specifications covering: (a) Electrical drawings for the layout of the telemetry system, and facility monitoring needs. (b) Instrumentation drawings for the telemetry system and facility monitoring needs. (2) Update the existing radio survey to include 8 additional RTU stations ($ lift stations) utilizing the water tank repeater site. Report will document recommended antenna heights for the system. B. Permitting: No agency permits are anticipated to be required for the construction of this project. Tt HAI assumes that the existing FCC radio license have been updated per FCC • TETRATECH HAf Ms. Tamara Richardson, P.E. October 2, 2006 Page 3 of 6 requests. Tt HAI will provide construction notification to the FCC for License WPXE-488. City will be responsible for application or notification fees. C. Bidding and Award Project Upon authorization by the City to proceed with the Bidding Phase of the project, Tt HAI shall: 1. Provide to the City with three (3) copies of the Contract Documents engineering drawings and specifications) and any Addenda, which may be issued during bidding for the City's use, and two (2) copies for distribution to bidding service agencies, such as Dodge Reports. Additional sets required for bidding will be sold to bidders or others for a nominal fee approximately equal to the engineer's cost of printing and handling. 2. Review and evaluate the apparent iow bidder's qualifications for undertaking the work. 3. Consult with and advise the City as to the acceptability of a subcontractors and other persons and organizations proposed by the prime contractor for those portions of the work as such acceptability is required by the bidding documents. 4. Consult with and advise the City as to the acceptability of substitute materials and equipment proposed by Contractor when substitution after the Award of Contract when allowed by the bidding documents. 5. Assist the City in evaluating bids or proposals and make recommendation for the Award of Contract; and assist the City in obtaining the Insurance Certificates and other such submittal items required from the Contractor by the Contract Documents so that construction of the projects can commence. 6. Prepare three (3) copies of a conformed set of Contract Documents for distribution to the City and the recommended Contractor. D. Construction Management Upon award of the contract, Tt HAI will conduct a preconstruction conference with the selected Contractor, subcontractor and the City. In addition, during the Construction Phase of the project, Tt HAI shall: • 1. Conduct monthly site visits to the construction site to observe construction of the project. These site visits will coincide with the monthly construction progress meetings (progress meetings have been included in this scope of services). October 2, 2006 Page 4 of 6 construction and its general conformance to the Contract Documents. In addition, Tt HAI will notify the City of observed work which does not conform to the Contract Documents, make recommendations to the City for its correction, and when authorized by the City, issue instructions to the Contractor, through the City`s representative, to carry out the corrective measures. Four (4) site visits and progress meetings are included. 2. Provide interpretation or clarification of the design documents when requested, and prepare change orders required for clarification or minor modification of the Contract Documents prepared by Tt HAI. 3. Review shop drawings and other required Contractor submittals up to two (2) times per submittal for general conformance with the Contract Documents. 4. Review the Contractor's applications for payment and the accompanying data and schedules, determine the amounts owed to the Contractor, and advise the City of the recommended payments to the Contractor. 5. Conduct a substantial completion site visit and develop a punch list of items to be corrected by the Contractor. 6. Conduct complete site visit to determine if the punch list items have been completed in accordance with the Contract Documents and if the Contractor's obligations are fulfilled there under, Tt HAI may recommend that the City make final payment to the Contractor. E. Project Assumptions and Services Not Included: 1. It is anticipated that no field surveying services will be necessary, therefore survey work is not included in the scope of services. 2. City will provide an escort, to all sites, far the Advantage Communications representative during the radio survey and Tt HAI during substantial and final completion inspections. 3. Advertising: Cost of advertising the project shall be paid for by the Owner. 4. Resident inspection services during construction are not included within the project scope. 5. Additional or extended services during construction made necessary due to the project not being completed on time by the Contractor are not included within this project scope. • TETRATECH HAi Ms. Tamara Richardson, P.E. The City has made the decision to retire its West Side Wastewater Treatment Facility (WWTF) and to reroute the wastewater flow to the East Side WRF. On the East Side WRF site, the City currently uses a total of seventeen (17) percolation ponds for effluent disposal when the demand or parameters for public access reclaimed water is not available. The current permitted disposal capacity for the total ponds is 0.75 million gallons per day (mgd) based on an annual average flow rate. As part of the Phase 2 project the City wishes to re-rate and modify the existing percolation ponds on the East Side WRF to reflect intermittent operations backup effluent disposal to the City's reclaimed water system. The following presents the specific tasks, which will be performed under this Scope of Services. Because of the nature of this work, certain assumptions have been made in preparing this Scope of Services. To the extent possible, these assumptions are stated herein and are reflected in the budget for services. If the work tasks required are different from the assumptions presented herein or if the City desires additional services, the resultant changes in scope and budget will serve as a basis for modifying this Scope of Services as agreed to by both the City and Boyle. Boyle's Scope of Services Boyle's services will include serving as the City's professional engineering representative for the Project, providing professional engineering consultation and advice and furnishing process, civil, geotechnical, controls, and electrical engineering services. Task Group 1-Effluent Disposal Modifications 1.1 Provide Hydrogeotechnical Services to Model revised Pond Layout. Boyle will team with a Hydrogeotechnical Subconsultant (Subconsultant) to perform hydrogeotechnical services related to the percolation pond modifications. The Subconsultant will perform fieldwork and review the existing percolation pond data to determine soil and groundwater parameters. Subconsultant will • Boyle Engineering Corp. The modeling will look at peak flow capacity for an extended • period (30-90 days) to provide an annual average for the remaining percolation pond system. Subconsultant will also assist with revisions to the East Side WRF Operations Permit or permit modifications, which will be issued by the Florida Department of Environmental Protection (FDEP). 1.2 Meet with the City to review the Hydro~eotechnical Modeling Results. Boyle and the Subconsultant will meet with the City to discuss the results of the Model. At this meeting it is assumed that the results will be finalized and a technical memorandum can be prepared for submittal to FDEP. 1.3 Provide a technical memorandum report to FDEP with the recommended modifications. Boyle will prepare a technical memorandum from the conclusion of the above City meeting. The memorandum will be submitted to FDEP with the final model results. 1.4 Submit modified text to FDEP and answer request for additional information (RAIs, related to the Effluent Disposal Issues (Assume 1 RAID Submit a permit modification to the FDEP wastewater treatment facility operations and construction permit for the phase 2 expansion (Task Order No. 9). For budget purposes Boyle has included time to review and respond to one (1) RAI from FDEP related to the permit modification. 1.5 Update the Civil Drawings and_technical specifications with the recommended modifications and changes to the monitorin wells. Boyle will incorporate approved modifications to the • percolation ponds as well as the new monitoring well system. It is assumed that these modifications will be included within the East Side WRF Phase 2 Expansion construction documents (Task Order No. 9). Services Not Included The following services are not included in this Scope of Services: • Services related to the design of alternative bid items. City's Responsibilities The City shall be responsible for providing the following in a timely manner so Boyle can complete its work and not delay the performance of services. • Designate the City Engineer, or her designated agent, to act as City's representative with respect to the services to be rendered under this Agreement. The City Engineer or her agent shall have complete authority to transmit instruction, receive information, and interpret and define City's policies and decisions with respect to Boyle's services for this Project. • Provide all criteria and full information as to City's requirements for the Project, including . design objectives, constraints, capacity and performance requirements, flexibility, and Boyle Engineering Corp. Seven (7) days have been allocated in the schedule for each City review. • Pay all permit and approval fees. • All information provided to the Boyle by the City, and others retained by the City, shall be used without verification. • Promptly advise Boyle when the City becomes aware of any defect, deficiency or changed condition. • Provide other such services and assistance as needed to expedite and complete this Project. Deliverables (BOYLE) Boyle will provide the City the following deliverables: • Four (4) copies of the Technical Memorandum Reports in draft and final form. • Four (4) copies of draft construction documents, at the 50% and 90% level. This matches the deliverables within Task Order No. 9. • • Ten (10) sets of conformed construction documents. This matches the deliverables within Task Order No. 9. • Sufficient sets of each permit application to supply the permitting agency plus one copy for the City's files. This matches the deliverables within Task Order No. 9. • One (1) set of reproducible Record Drawings based upon information provided by the City and Contractor. This matches the deliverables within Task Order No. 9. Period Of Service The schedule provided herein is based on the timely receipt of the information to be provided by the City. It is anticipated that the overall schedule for this Task Order shall match the schedule provided within the Task Order No. 9. • Boyle will commence work upon receipt of an executed copy of this agreement. • The Hydrogeotechnical Services will be complete 40 calendar days from the receipt of the notice-to-proceed. • The Technical Memorandum for the percolation ponds will be complete 14 calendar days from the date of the review meeting with the City. • Boyle Engineering Corp. Compensation Boyle shall be paid in accordance with Section 3 of the Agreement. A budget showing the estimated number of hours and other project fees for the tasks described within the Task Order is presented in the Project Budget. These budgeted amounts were used to determine the lump sum of $65,416.00 for the project. Monthly progress payments are allowed, based on Boyle's estimate of percent complete for each Task Group. Authorization This Task Order serves as an Exhibit to the Consultant Agreement dated, August 12, 2003, between the City of Clermont and Boyle Engineering Corporation, and is hereby incorporated into this Task Order by reference as though set forth in full. Task Order No. 12 6/20/2006 Clermont Task Order 12rev1 AGREEMENT FOR PROFESSIONAL SERVICES AGREEMENT is entered into on the ~Z day of ~~ S'~ , 2003, by and between hereinafter called "CITY," and BOYLE ENGINEERING CORPORATION, a California corporation, hereinafter called "BOYLE," as follows: CITY engages BOYLE to perform professional services for various projects as described by individual Task Order. Each Task Order shall be attached as an Exhibit to this agreement, numbered sequentially, hereinafter called the "PROJECT." CITY and BOYLE, for mutual consideration, agree as follows: 1. Scone of Services. BOYLE and CITY desire to set forth the terms and conditions whereby BOYLE may from time to time be engaged to provide services to CITY, the particulars of each engagement to be set forth in an individual Task Order. Such Task Orders shall be considered Exhibits to this agreement. 2. Schedule. BOYLE shall perform its services in accordance with the schedule set forth in the Task Order. Time is of the essence in this agreement. CITY agrees that BOYLE shall not be responsible for delays which are due to causes beyond BOYLE'S reasonable control. Itl the case of any such delay, the time for completion of BOYLE'S services hereunder shall be extended accordingly. 3. Compensation. . a. Fees. CITY agrees to pay BOYLE as compensation for its services in accordance with the fees and/or rates and terms set forth in the Task Order. Fees and all other charges will be billed monthly as the work progresses, and the net amount shall be due at the time of billing. Should CITY dispute in good faith any portion of an invoice, CITY shall pay the undisputed portion as provided herein. Interest of 1.5% per month (but not exceeding the maximum rate allowable by law) will be payable on any amounts wrongfully withheld or not paid within thirty days of the billing date, payment thereafter to be applied first to accrued interest and then to the principal unpaid amount. Any attorneys' fees or other costs incurred in collecting any delinquent amount shall be paid by CITY. b. Project Delay. In the event that BOYLE'S services hereunder are delayed for a period in excess of six months due to causes beyond BOYLE'S reasonable control, BOYLE'S compensation shall be subject to renegotiation. c. Retention. If any portion of BOYLE'S fee is held in retention, such amount shall be released within thirty days after completion of the corresponding services. Interest shall be paid at the rate of 1.5°/t, per month on any retention amounts not paid within this thirty-day period. d. Partial Services. In the event any portion of the work prepared or partially prepared by BOYLE is suspended, abandoned, or terminated, CITY shall pay BOYLE for the work performed on such portion on an hourly basis, not to exceed any maximum contract amount specified herein. 4. Standard of Care. In the performance of its professional services, BOYLE will use that degree of care and skill ordinarily exercised under similar conditions in similar localities and no other warranties, express or implied, are made or intended in any of BOYLE'S proposals, contracts or reports. BOYLE shall be entitled to rely upon the accuracy of data and information provided by CITY or others without independent review or evaluation unless provided otherwise in Task Order. BOYLE shall perform its services in connection with applicable laws, rules, ~_regulations and standards that are in effect as of the date of this agreement. If any changes occur in such laws, rules, StdAgree. Rev. 4/2001 regulations or standards that materially affect the scope of work or schedule of this agreement, BOYLE'S compensation shall be renegotiated accordingly. 5. Construction Safety and Methods. CITY agrees that in accordance with generally accepted construction practices, the construction contractor will be required to assume sole and complete responsibility for job site conditions during the course of construction of the PROJECT, including safety of all persons and property, and that this requirement shall be made to apply continuously and not be limited to normal working hours. BOYLE shall not have control over or charge of, and shall not be responsible for, construction means, methods, techniques, sequences or procedures, as these are solely the responsibility of the construction contractor. BOYLE shall not have the authority to stop or reject the work of the construction contractor. 6. Opinion of Construction Cost. Any Opinion of the Construction Cost prepared by BOYLE represents its judgment as a design professional and is supplied for the general guidance of CITY. Since BOYLE has no control over the cost of labor and material, or over competitive bidding or market conditions, BOYLE does not guarantee the accuracy of such opinions as compared to contractor bids or actual cost to CITY. 7. Insurance Requirements. Each party shall maintain the following minimum limits and conditions of insurance for the duration of the PROJECT: a. Professional Liability. Professional Liability insurance in a combined single limit not less than $1,000,000 per claim and aggregate including contractual liability coverage and prior acts coverage coincident with or preceding the start date of the PROIECr. b. Workers' Compensation. Workers' Compensation in the statutory limits required by law, and Employer's Liability in a limit not less than $1,000,000 for each accident, $1,000,000 by disease (policy limit), and $1,000,000 by disease (each employee). • c. General Liability. General Liability insurance as follows: Bodily Injury, Personal Injury and Property Damage in a combined single limit of not less than $1,000,000 each occurrence and $2,000,000 aggregate. The General Liability policy shall include the commercial form, contractual liability and independent contractor's coverage. d. Automobile Liability. Automobile Liability insurance as follows: Bodily Injury and Property Damage coverage in a combined single limit of not less than $1,000,000 for each accident. The Automobile Liability policy shall include the business form, owned, hired and non-owned coverages. Property Coverage. Property coverage in limits sufficient to remedy the loss, and/or loss of use of, valuable papers and records, and any other property of the party utilized in connection with the PttO1ECr. The liability coverages, (c) and (d) above, shall each contain an endorsement nanung the CITY as an additional insured as to any liability arising out of insured party's performance pursuant to this agreement. The Workers' Compensation and Employer's Liability coverage, (b) above, shall contain an endorsement waiving subrogation as against the CITY. 8. Instruments of Service. All tracings, survey notes, machine-readable information and data ("CADD data") and other original documents are instruments of service and shall remain the property of BOYLE, except where by law or ~re~ecicnt-these-documents-bec~rr-e-pu171 ie-pr-ape. StdAgree. Rev. 4/2001 9. Reuse of Documents. Documents, including drawings and specifications, prepared by BOYLE pursuant to this agreement are not intended or represented to be suitable for reuse by CITY or others on extensions of the PROJECT or on any other project. Any use of completed documents for other projects afld any use of incomplete documents without specific written authorization from BOYLE will be at CITY'S sole risk and without liability to BOYLE. Further, any and all liability arising out of changes made to BOYLE'S deliverables under this agreement by CITY or persons other than BOYLE is waived as against BOYLE and the CITY assumes full responsibility for such changes unless CITY has given BOYLE prior notice and has received from BOYLE written consent for such changes. 10. CADD Data. CADD data delivered to CITY shall not include the professional stamp or signature of an engineer or architect. CITY agrees that BOYLE shall not be liable for claims, liabilities or losses arising out of, or connected with (a) the modification or misuse by CITY, or anyone authorized by CITY, of CARD data; (b) the decline of accuracy or readability of CARD data due to inappropriate storage conditions or duration; or (c) any use by CITY, or anyone authorized by CITY, of CARD data for additions to this PROJECT, for the completion of this PROTECT by others, or for any other project, excepting only such use as is authorized, in writing, by BOYLE. By acceptance of CARD data, CITY agrees to indemnify BOYLE for damages and liability resulting from the modification, use or misuse of such CADD data. 1 1. Construction Contractor. a. Construction Contractor Indemnification. CITY will require that any construction contractor performing work in connection with the PROJECT hold harmless, indemnify and defend CITY, BOYLE, their consultants, and each of their directors, officers, agents and employees from any and all liabilities, claims, losses, damages and costs, including attorneys' fees, arising out of or alleged to arise from the construction contractor's performance of the work described in the construction contract documents, but not including liability that may be due to the sole negligence of CITY, BOYLE, their consultants, or their directors, officers, agents and employees. . b. Coi:struction Contractor Insurance. CITY also will require that the construction contractor provide workers' compensation and commercial general liability insurance, including completed operations and contractual liability, with the latter coverage sufficient to insure the construction contractor's indemnity, as above required; and such insurance shall include CITY, BOYLE, their consultants, and each of their directors, officers, agents and employees as additional insureds. The insurance afforded to these additional insureds shall be primary insurance. If the additional insureds have other insurance which might be applicable to any loss, the amount of the insurance provided under this paragraph shall not be reduced or prorated by the existence of such other insurance. c. Construction Contract Documents. CITY will provide a copy of the construction contract documents before they are executed in order that BOYLE may confirm that the above requirements have been met. CITY agrees to forward to BOYLE a complete copy of the fully executed construction contract documents. The documents copied to BOYLE will include, but not be limited to, the executed agreement, bonds, insurance certificates and endorsements. 12. Fees and Permits. CITY shall pay the cost of all fees, permits, bond premiums, title company charges, blueprints and reproductions in connection with the PROJECT and BOYLE'S services hereunder unless otherwise specified in the Task Order. 13. Asbestos/Hazardous Materials. BOYLE is not licensed to provide services involving the identification or handling of asbestos or hazardous materials. Therefore, in providing its services hereunder, BOYLE shall not be responsible for the identification, handling, containment or abatement of any asbestos or other hazardous material present in connection with the PROJECT. In the event that CITY becomes aware of the presence of asbestos or any other hazardous material at the jobsite, CITY immediately shall notify BOYLE. BOYLE shall be entitled to cease any of its services that may be affected by the asbestos or other hazardous material and shall not be liable for damages in connection with such termination of services. Rev. 4/2001 indemnify and defend BOYLE, its consultants, agents, directors, officers and employees from all claims, damages, losses and expenses, including but not limited to attorneys' fees and court and arbitration costs (collectively "the Liabilities"), which Liabilities are related to asbestos or other hazardous materials and arise out of work performed on the PttOJECT by others. 14. Termination of Agreement. In the event CITY fails to pay BoYLE within thirty days after an invoice is rendered, then CITY agrees that BOYLE shall have the right to consider said default a total breach of this agreement and the duties of BOYLE under this agreement terminated upon five days' written notice. This agreement may be terminated by either CITY or BOYLE upon thirty days' written notice in the event of substantial failure of the other party to perform in accordance with the terms of this agreement. CITY expressly agrees to hold BOYLE harmless from any liability arising out of BOYLE'S termination of its services hereunder due to CITY'S failure to perform andlor pay in accordance with the provisions of this agreement. In the event of termination of this agreement, CITY shall promptly pay BOYLE for all of the fees, charges and services performed by BOYLE in accordance with the compensation arrangements under this agreement or on an agreed hourly basis. 15. Dispute Resolution. The parties agree in good faith to attempt to resolve amicably, without litigation, any dispute arising out of or relating to this agreement. In the event that any dispute cannot be resolved through direct discussions, the parties agree to endeavor to settle the dispute by mediation. Either party may make a written demand for mediation, which demand shall specify the facts of the dispute. The matter shall be submitted to a mediator who shall hear the matter and provide an informal nonbinding opinion and advice in order to help resolve the dispute. The mediator's fee shall be shared equally by the parties. If the dispute is not resolved through mediation, the matter may be submitted to the judicial system, in which event all litigation and collection expenses, witness fees, court costs and attorneys' fees shall be paid to the prevailing party. 16. Assignment. Services provided under this agreement are for the exclusive use of CITY. Neither CITY nor BOYLE shall assign its interest in this agreement without the written consent of the other. i 7. Severability. Should any provision herein be found or deemed to be invalid, this agreement shall be construed as not containing such provision, and all other provisions which are otherwise lawful shall remain in full force and effect, and to this end the provisions of this agreement are declared to be severable. 18. Other Agreements. There are no understandings or agreements except as herein expressly stated. Any purchase order issued by CITY for the services to be provided hereunder shall be deemed to have been issued for its own purchasing, accounting and other record-keeping purposes only and shall not be deemed to be a part of this agreement or to modify or amend this agreement in any way. This agreement may only be modified by a writing signed by both parties. 19. Counterparts. This agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. 20. Governing Law. This agreement shall be governed by and construed in accordance with the laws of the state of Florida. 21. Retrofit Services. CITY acknowledges that BOYLE'S services will be performed based upon information provided by others and visual inspection of the structure(s) only. CITY shall indemnify BoYLE for all claims, demands or costs of, or liability to third parties for, property damage, physical injury or death arising from or connected with (a) the initial construction of the structure(s) and any modification to the structure(s) prior to the date of this agreement; and (b) any conditions that are not reasonably detected by visual inspection or review of information provided by others. 22. Prohibition Against Contingent Fees. The City has made the decision to retire its West Side Wastewater Treatment Facility (WWT'F) and to reroute the wastewater flow to the East Side WRF. The rerouting will be accomplished through the construction of a new force main and by rerouting existing lift stations if possible. Figure 1 shows the route of the proposed force mains. Modifications t'o Lift Station E-4 and E-18 will also be required. The force main and lift station improvements are described in the report titled, "West Wastewater Treatment Facility Reuse Alternative Analysis'; prepared by Boyle and dated March 2004. The City desires to have Boyle provide professional engineering services relative to the design, permitting, bidding and construction activities for the East Side WRF expansion project. This Scope of Services is based on the following assumptions: 1. All above ground structures will be demolished at the West VWVTF with the exception of the equalization tank with its blower building and the operations/electrical building. 2. The equalization tank at the West WWT'F will be converted to a re-pump station with a concrete divided wet well. The aeration system will need to be reconfigured to accommodate the new wet well arrangement. New submersible pumps and appurtenances will be provided. The existing blowers will remain in service. 3. The route and sizes of force mains will be as shown on Figure 1. There could be modifications to the route based on the outcome of the Wastewater Master Plan being developed by Boyle. 4. Improvements to Lift Stations E-4 and E-18 will be limited to modifications to the pumps and piping. 5. A new 3,500 gpm pump will be installed in the space that was provided for a future pump. The firm capacity of the transfer pump station will be 10 rngd following the expansion. h) Aerobic Sludge Di esg tion: Anew aerobic sludge digestion system will be constructed from reinforced concrete.tanks. Arotary drum thickener will be provided to thicken the sludge prior to digestion. The aeration blowers for the new diffused aeration system will be installed outdoors on a concrete slab. The new aerobic sludge digestion system will be designed to serve a wastewater flow of 2.0 mgd. A fenced storage yard will be constructed adjacent to the maintenance building. m) Generator: An emergency power generator and fuel tank will be designed to support the 2.0 mgd expansion. It is assumed that the generator will be installed outdoors in a weather proof enclosure. The new generator will be similar in design to the existing generator. n) Site Work: Approximately 30 additional parking spaces will be added to the site to accommodate the additional staff that will be based at the East Side WRF. o) SCADA System: The plant-wide Supervisory Control and Data Acquisition (SCADA) system will be modified to address new and/or modified facilities. p) Office Building: A new 5,000 sf office building will be constructed that will include a new control room that will house SCADA for the WRF, the lift station system and the potable water system. The new office building will be designed be resist the effects of hurricanes. Design criteria such as wind loads will be selected during preliminary design. 6. The existing FDEP permit for the East Side WRF will require a major modification to address the expansion. The Environmental Resource Permit (ERP) will require a minor modification to address the changes that are required to conform to Boyle's design. • 7. Effluent disposal will be accomplished using a combination of the existing RIBs and the City's reuse customers. Expansion of the RIB sites will not be included iri the project. The following presents the specific tasks, which will be performed as part of this Scope of Services. Because of the nature of this work, certain assumptions have been made in preparing this Scope of Services. To the extent possible, these assumptions are stated herein and are reflected in the budget for services. If the work tasks required are different from the assumptions presented herein or if the City desires additional services, the resultant changes in scope and budget will serve as a basis for modifying this Scope of Services as agreed to by both the City and Boyle. Boyle's Scope of Services Boyle's services will include serving as the City's professional engineering representative for the Project, providing professional engineering consultation and advice and furnishing customary process, civil, structural, mechanical, geotechnical, controls, and electrical engineering services and architectural services incidental thereto. Task Group 1-Preliminary Design/Permitting Boyle will prepare an engineering report that will summarize design criteria and unit process sizing for the 2.0 mgd expansion. The report will be structured to satisfy the requirements of the FDEP for permitting the plant expansion. The report will include site and yard piping plans; process flow diagram mass balance and a hydraulic profile. The force main will be depicted in plan and profile using a plan scale of 1 inch equals 20 feet. • Prepare Specifications: Boyle will prepare the Specifications for the project. • City Reviews : At the 50% and 90% completion milestones, Boyle will submit two (2) sets of drawings and specifications to the City for review and comment. The 90% submittal will include a construction cost estimate. Boyle will meet with the City to review and discuss each submittal. Each subsequent submittal will incorporate the City's previous review comments. At the 100% completion milestone, Boyle will submit three (3) sets of the bidding documents to the City. • Cost Estimates: An estimate of probable construction cost will be prepared for submittal along with each of the 50% and 90% review sets of drawings and specifications. • Lake County Build'nQ Permit: Boyle will submit plans to the Lake County Building Department for review and comment. Boyle will retain the collected fee to offset the cost of printing, postage, and handling. Boyle will provide up to six (6) sets of complimentary copies of the bidding documents to the Tampa and Orlando Dodge Rooms and other plan review rooms. • Respond to Ouestions: Boyle will respond to questions from bidders and vendors. • Pre-Bid Conference: Boyle will conduct and attend aPre-Bid Conference in the City's preferred location to review and answer questions from prospective bidders regazding the Construction Documents and to tour the Project Site. • Addenda: Boyle will prepare and issue Addenda to the Construction Documents, if required, which will address the questions raised at the Pre-Bid Conference; and respond to other written issues and questions. It is anticipated that no more than two addenda will be issued. • Bid Review: Boyle will review bids submitted to the City, tabulate the bids, check the low a bidders' references, and prepare and submit a letter of recommendation of the lowest, responsible bidder. Task Group 6-Construction Phase Boyle will provide construction phase as described below. Two (2) sets of the monthly report package will be prepared. One (1) set will be submitted to the City, and Boyle will retain one (i) set. • • Substantial Completion Review: Boyle will conduct a construction review ofthe Project with City and Contractor to confirm substantial completion of construction in substantial compliance with Construction Documents. • Final Punch List: Based on the results of the Substantial Completion Review, Boyle will prepaze a final contractor's punch list, which details uncompleted and/or improperly constructed items identified during the substantial completion review and submit this list to Contractor and City. • Final Inspection: Boyle will conduct a final inspection of the Project with the City and Contractor (and FDEP, if necessary) to review completion of construction in compliance with the Construction Documents. • Record Drawings: Based on information provided to Boyle by the Contractor and City, Boyle will prepare and provide City with a set of reproducible record drawings that incorporate significant changes made during construction. • Certify Completed Construction: Boyle will certify, the completed construction to FDEP (Construction Permit and Environmental Resource Permit) and City. • Maintenance Manual: Boyle will require the Contractor (and equipment vendors) to prepare a Maintenance Manual the major items of equipment that were furnished and installed at the East Side WRF. -- --- Boyle Engineering Corp. The City Engineer or her agent shall have complete authority to transmit instruction, receive information, and interpret and define City's policies and decisions with respect to Boyle's services for this Project. • • Provide all criteria and full information as to City's requirements for the Project, including design objectives, constraints, capacity and performance requirements, flexibility, and expandability, and furnish copies of all design and construction standazds which City will require to be used onJincluded in the Project. • Provide RPR services for the force main/lift station portion of the project. • Promptly review, comment on, and return Boyle's submittals. Seven (7) days have been allocated in the schedule for each City review. • Pay all permit and approval fees. • All information provided to the Boyle by the City, and others retained by the City, shall be used without verification. However, the Boyle shall use engineering knowledge and experience to identify reasonably identifiable en-ors. • Promptly advise Boyle when the City becomes aware of any defect, deficiency or changed condition. • Provide other such services and assistance as needed to expedite and complete this Project. The overall services for design are anticipated to be completed within 10 months of receipt of the Notice-To-Proceed. • • Boyle will commence work upon receipt of an executed copy of this agreement. • The draft Preliminary Design Report will be completed within 45 calendaz days of the date that Boyle is in receipt of the required information from the City as outlvned above. • The final Basis of Design Report will be completed 7 days following receipt of written City comments on the draft. • Draft 50% construction documents (plans and specifications) will be provided for both contracts within 90 days after approval of the Preliminary Design Report. • Draft 90% construction documents (plans and specifications) will be provided for both contracts within 60 days a$er receiving comments on the 50% submittal. • Final construction documents 15 days after draft documents have been reviewed. • Bidding phase services will be completed 60 days after that task's authorization. • Construction services (when authorized) shall continue throughout the construction activities and shall be complete 60 days following the end of construction. This proposal outlines our understanding of the project, presents a scope of services and detailed fee estimates. The existing City of Clermont East Side WRF facility is located in Section 3, Township 23 South, Range 26 East in Lake County, Florida. The existing facility, which includes a total of 17 rapid infiltration basins (RIBs), is located east of Hancock Road approximately 1 mile south of S.R. 50. Two of the RIBs will be removed for the construction of two new above-ground storage tanks associated with the expansion of the reclamation facility. The City of Clermont has requested an evaluation to determine if the two RIBS (DP-il and DP-12) will need to be replaced or if the remaining 15 RIBS can handle the permitted disposal design capacity (0.75 million gallons per day). Additionally, the City of Clermont has requested an evaluation of the peak capacity of the RIB's for limited periods (1 to 3 months). In preparing this proposal, we reviewed available soil, hydrogeologic and other geotechnical bulletins as well as reports prepared by Devo Seereeram, P.E., who performed hydrogeologic evaluations for the site in 1994 and 1995. Review of this data indicates that existing ground surface elevations at the site range from about +230 to +170 feet NGVD with very deep groundwater levels. Groundwater levels are estimated to be greater than 80 feet beneath existing grade. Subsoils primarily consist of relatively clean sands to depths of 50 to 100 feet beneath the existing ground surface. Parameters to be presented to Ground Water Section (City of Clermont) prior to initiating mounding analyses. • Task No. 4 - Pertorm groundwater mounding analyses using MODFLOW to evaluate the impact of removing two (2) RIBS. • Task No. 5 - Perform groundwater mounding analyses using MODFLOW to evaluate the impact of peak RIB capacity for limited periods (1 to 3 months). • Task No. 6 - Review existing Groundwater Monitoring Plan and modify as needed. • Task No. 7 - Evaluate the feasibility of removing some of the separator berms in the existing RIB system. A detailed scope and cost estimate for each of these tasks is shown on the attached tables. With the exception of Task 2, all Tasks involve only engineering personnel. Task 2 will include extending one Standard Penetration Test (SPT) boring to a depth of 200 feet in order to evaluate surifical aquifer characteristics at the subject site. Please note, GEC is performing the subsurtace exploration for the design/construction of the two new aboveground storage tanks at the site. Therefore, we are proposing extending one of the borings for the tank from 100 feet to 200 feet and have included the costs for the second 100 feet of boring in this proposal. For Task 2, we will also measure groundwater levels in the three (3) existing groundwater monitoring wells on site.
