A G R E E MEN T
This Agreement by and between the CITY OF CLERMONT, a municipal corporation
under the laws of the State of Florida, hereinafter referred to as CITY, and THOMAS

JONES, hereinafter referred to as FRANCHISEE, dated this 21st day of
June
, 1977.
WHEREAS, the CITY owns possessory interest in West Beach on Lake Minneola
in the City of Clermont, and
WHE~AS, West Beach is a public beach providing recreational activities for
the public, and
WlffiREAS, THOMAS JONES has requested an exclusive franchise to provide a food
and drink concession at West Beach for the benefit of the public.
NOW, THEREFORE, the parties agree as follows:
1. CITY grants to FRANCHISEE an exclusive franchise to operate a food and
drink concession at West Beach on Lake Minneola.
2. FRANCHISEE agrees to provide food and drink concession to the public in
accordance with all governmental regulations and hereby agrees to obtain all necessary
permits. FRANCHISEE agrees to clean the public restrooms located at West Beach and

to keep the concession stand in a neat and orderly manner. FRANCHISEE further agrees

to clean the. West Beach area of any articles or trash occasioned by .the concession

stand. FRANCHISEE further agrees not to sell any food or drink or other concessions
in glass bottles.
3. FRANCHISEE hereby releases the CITY from any claims or damages arising from
this franchise agreement and from the operation of the concession. FRANCHISEE further
agrees to indemnify the CITY for any damages the CITY may suffer as a result of the
operation of the food and drink concession.
4. This franchise is granted for a term of one (1) year commencing on the
