1985-09INTERLOCAL AGREEMENT
THIS AGREEMENT entered into this 12th day of
February , 1985, by and between the CITY OF Clermont
hereinafter referred to as "City" and LAKE COUNTY, hereinafter
referred to as "County".
WHEREAS, County is planning to undertake a program of
resource recovery of solid waste, and
WHEREAS, in order for such resource recovery program to
work, County must ensure that a minimum amount of solid waste and
garbage is provided, and
WHEREAS, F.S. 403.713 and 163.01 allow cities and counties
to enter into agreements for the disposal of solid waste, and
WHEREAS, F.S. 403.713 allows cities and counties to.
institute flow control ordinances for the purpose of ensuring
that the resource recovery facility receives an adequate quantity
of solid waste.
NOW THEREFORE, it is agreed as follows:
1. County agrees to undertake a resource recovery of solid
waste program.
County agrees that it will dispose of all solid
waste provided by City during the term of this Agreement. County
agrees that such disposal will comply with all state and federal
regulations concerning such disposal.
2. City agrees to enact a flow control ordinance as
provided in F.S. 403.713 to ensure that all solid waste generated
in City is received by County' to be used in the operation of
County's resource recovery facility.
3. It is agreed and understood that County will be required
to charge a fee for disposal of solid waste (tipping fee). Such
fee shall be set by County annually prior to the beginning of
each fiscal year.
4. This Agreement shall be effective for a term'of fifteen
years.
