1984-03 ,. . ~. 84 -03A AGREEMENT This Agreement, by and between the CITY OF CLERMONT, a municipal corporation, duly organized and existing under the laws of the State of Florida, Lake County, Florida, hereinafter referred to as "CITY", and EDWARD L. AUGUSTINE, hereinafter referred to as "OWNER". WHEREAS, CITY is the owner of a certain tract of land in Block 100, City of Clermont, which tract is presently utilized as a parking lot, and WHEREAS, OWNER is the owner of a certain tract of land adjacent to the above- described parcel which tract is presently utilized as warehouses and offices under Conditional Use Permit Nos. 83-05 and 82-14, and WHEREAS, OWNER desires to construct an opening in the fence as described in the Conditional Use Permits for egress from the parking area of his property, which opening would face the property owned by the CITY. NOW, THEREFORE, in consideration of the mutual covenants and conditions herein described, the parties agree as follows: 1. CITY grants to OWNER permission to create the opening as described in copy . of site plan. attached hereto. 2. The opening shall be utilized for purposes of egress from O\VNER'S parking area. 3. Nothing herein shall be construed as granting to OWNER any special right in CITY'S parking area, including, but not limited to, easement, license or any interest whatsoever. 4. This Agreement may be rescinded by the CITY at any time upon determination that a hazard is being created, or in the event the CITY determines it has a need for the parking area which would be inconsistent with the permission granted to OWNER by this Agreement.
