1982-19 / .~: "- , \ .'/ ,82-/9 '" ..... - ~ VOLUNTARY COOPERATION AGREEMENT This Agreement made by and between the City of Clermont, WITNESSETH: WHEREAS, the Agencies are so located ln relation to each 6ther that it is,to the advantage of each to receive and extend aid in the form of law enforcement services in circumstances in- cluding riots, civiY disturbances, and other major law enforce~ent situations falling short of a disaster under Chapter 252, Florida Statutes; and i" WHEREAS, it is recognized that the use of law enforcement duties outside their own jurisdictional limits may be desirable and imperative under certain circumstances to preserve and protect the public health, safety and welfare; and WHEREAS, authority is provided by Chapter 23, Florida Statutes, for requesting, rendering, and receiving such aid: NOW, THEREFORE, BE IT KNOWN THAT the agencies hereby approve and enter into this agreement whereby each of the aforesaid Agencies may request ~nd render law enforcement assistance to the other, in riots, civil disturbanges, labor disputes, or other law enforcement intensive situations falling short of a disaster under Chapter 252, 'Florida Statutes,,' :;:;ubj~'ct to the following terms and conditions: " 1. Requests for assistance pursuant to this Agreement shall be made by the Agency Head or a Commander of the requesting Agency and .~ ,/ \ .' ;i communicated to the head or"Commander of the Agency whose aid is requested. ',4. Law enforcement personnel responding to a request under this agreement shall be subject to ,the overall command of the, Agency Head of the Agency requesting assistance, or his designee. 5. Any law enforcemeI1t officer, acting outSide ,his" jurisdi:ction 'pursuant to an assistance request under this Agreement shall have the same powers, duties, rights, privileges, and immunities as if they were performing their duties in the political subdivision'in which they are normally employed. 6. ' L~w enforcement assistance 'shall be rendered without ~~arge to the requesting Agency provided, however, if at the request of the re9uesting Agency the assisting Agency is requested to seek assis- tance from another source whj9h~m~oses a charge for same, then the Agency requesting' such assistance from' another source shall bear all costs and expenses of such a9sista,nce.' f . . 7. ' under any circumstances, be ?~ld liabl~'for any loss or damage by reason of its failure to'effect~vely combat or handle any police problem out~ide its'o~rr jurisdicbion. ~~ch'Agency sball itself bear any liability which may arise from acts undertaken pursuant to this Agreement by employees of that Agency. 8. Whenever an officer incurs injury or d,eath while acting in 'accordance with a request for aid made pursuant to this Agreement, all life insurance and death benefits, hospitlaization and surgical and other medical expenses, annuities, wage and disability payments, sick pay, p~nsion and workmen's compensation, claims and benefits, shall be settled and paid in accordance with the appropriate insur- ance ,or compensation progra~s of the Agency regularly employing such officer. For purposes of this section only, officer~ regularly em- ployed by the Agency rendering aid are hereby considered to be engaged in the performanc~ of their dutie~ as law enforcement officers of such Agency even though acting with or on behalf of an Agency requesting aid .> , / " - \ ./ ) ,/ pursuant to thi~ ~greement. An Agency, requesting assistance pursuant to this ,Agree~ent shall pro~ide meals as 'necessary to aBsisting personnel of" any agency rend'e~ing assistance under this' Agreement when meals ~re provided to the requestin'g Agency's personnel. Such, meals shall , beprovided~free of ch~r~e. 10. This Agreement shall commence on 1982, and shall terminate'on January , 1986. This Agreemeri~ may be renewed ~pon terms ~nd conditions as the partie~ may agree. 11., This Agreement may be terminated to either party upon thirty (30) days written,notice.
