WHEREAS, Owner desires to partially develop said property pursuant to the Code of Ordinances of the City of Clermont; and ,~. WHEREAS, the City's water and sewer system have not yet been extended to the site of the proposed construction and the Owner and the City have entered into certain agreements regarding the initial and subsequent development of the subject property. NOW THEREFORE, in consideration of the covenants and agreements contained herein, the parties agree: 1. Owner may construct one building for one principal business on the West 1/3 ~\. of said property, conditioned upon obtaining requisite permits. anQ compliance with all ordinances and regulations. 2. Owner may utilize one septic tank as approved by the Lake County Health Depart- ment for the building described above in lieu of tapping into the City sewer system~ 3. Owner shall pay to the City a sum equal to the cost of extending a 6" watet line from its present terminal to the North boundary of the subject property. In the event of further development of this property, Owner shall pay for the extension of the sewer system as required by the Code of Ordinances and the septic tank shall be disconnected. 5. Owner presently has ah option to purchase the property immediately South of . the subject property. This covenant shall be applicable to that property'in the event Owner obtains title thereto. 6.
