STATEMENT OF AGREEMENT

This Agreement is made and entered into between the governing body of the CITY
OF CLERMONT and the Lake County Chapter of the American National Red Cross.
RECITALS
The Red Cross Disaster Programs mitigate suffering by meeting the urgent needs
of victims and emergency workers immediately after a disaster has struck or in advance
~ of a potential disaster. This Red Cross help includes food, clothing, shelter, first
aid, and other basic elements for comfort and survival. Such help may be provided to
~
large numbers of people in Red ,Cross operated shelters in cooperation with church and
civic organizations. Families in shelters are assisted in moving back to their homes,
or to alternate homes if their own are untenantable, as quickly as possible.
The CITY OF CLERMONT authorizes the Red Cross to use its buildings, grounds and
equipment required in the conduct of Red Cross disaster relief activities and wishes
to cooperate with the Red Cross for such purposes. Jenkins Auditorium may be used
only as an alternative shelter. The Auditorium could not be used as a shelter without
the prior permission of the City Manager or City Council.
The parties hereto mutually desire to reach an understanding that will result
in making the aforesaid facilities of the CITY OF CLERMONT available to the Red Cross
for the aforesaid use.
NOW THEREFORE, it is mutually agreed between the parties as follows:
1. The CITY OF CLERMONT agrees that it will permit, to the extent of its ability
and upon request by Red Cross, the use of its physical facilities by Red Cross as a
mass shelter for victims of disasters.
2. Red Cross agrees that it shall exercise reasonable care in the conduct of
its activities in such facilities and further agrees to replace or reimburse the
CITY OF CLERMONT for any food or supplies that may be used by Red Cross in the conduct
of its relief activities in said mass shelter.
3. Red Cross agrees to protect, hold harmless and indemnify the CITY OF CLERMONT
only against legal liability in respect to bodily injury, death, property damage,
arising from the negligence of the American Red Cross in connection with their use
of said facilities.
IN WITNESS WHEREOF, the governing body of the CITY OF CLERMONT has caused this
Agreement to be executed by Head of the governing body and the Red Cross has caused
this Agreement to be executed by the Chairman of its Lake County Chapter, said Agreement
to become effective and operative upon fixing of the last signature hereto.
