1947-01This lease, made this 1st day of July, A. D. 947,
by and between the CITY OF CLERMONT a municipal corporation
of Lake Count:y, Florida. herein called the Lessor, and CLERMONT
ATHLETIC ASSOCIATIONS, a non-profit corporation organized under
the Laws of the State of Florida. by Order of the Circuit Court
of Lake County Florida, with its principal place of business
at Clermont, Lake County, Florida, herein called the Leesee,
WITNESSETH:
That in consideration of the covenants herein contained
on the part of the lessee to be kept and performed, the Lessor
does hereby lease to thesaid leese the following described
property, situate lying and being in City of Clermont, Lake
County, Florida, to-wit:
Blocks Five, (5) and Six (6). as represented On the
Official Map of the City of Clermont recorded ln
Plat Book 8, pages17 to 25, incluslve, of the
public records of Lake County Florida., together
with that portion of Juniata Street extending from
East Avenue to second street, Which has been closed
by resolution of the City Council.
T0 have and, to hold the same for a term of twenty (20)
years from the 1st day of July, A. D 1947, the Lessee paying
therefor any: taxes that may be levied and assessed against said
property by the County of Lake and maintaining said property in
accordanee with the terms of this agreement hereinafter set forth.
The leessee hereby covenants and agrees to make no unlaw-
ful, improper or offensive use of the property, not to assign
this Lease or to sublet any part of said premises without the
written consent of the Lessor, PROVIDED, HOWEVER, that the
athletic facilities to be provided on said premises may at any
timee be rented to any person, group,or organization for temporary
use not to exceed six months in duration.
The Lessee further covenants and agrees to lay out,
build and construct on said premises a oomplete baseball field,
including fencing, grandstand and other necessary faciIities
for the playng of baseball, all of which shall be built withln
one year from the date of this Lease.,

The Lessee further contracts and agrees to keep all
of sald premises cleaned of runbish, trash, weeds or other
objectionable or unsightly matter, to maintain and keep said
premises in good appearance, not to permit or allow any disorder
or objectionable conduct on the part of any persons uslng the
athletic facilities provided by it or in attendance at any athletic
contest.
It is further contracted and agreed that during the term
of this Lease at least one member of the City Council shall be a
member of the Executive Committee of th Lessee and in case the
form of corporate entity of the Lessee shall be changed from a
non-profit corporation to a buslness corporation, that one member
of the City Council shall be a member of the Board of Directors
of such business corporation as may become the lessee and operator
of the demised premises.
It is further contracted and agreed that upon the termi-
nation of this lease, the City of Clermont shall have the electlon
of whether to requlre the Lessee to quit and deliver the said
premises or to continue the tenancy of the Lessee upon such terms
as the City Council may at that time determine. In case the
City Council shall require the Lessee to quit and deliver up said
premises all improvements placed upon said premises by the Lessee
shall revert to and become the property of the Lessor.
IN WITNESS WHREOF The City of Clermont has caused its
name to be hereunto subscribed by its Mayor, and the execution
hereof attested and its sea affixed hereto by its Clerk, and
the Clermont Athletic Association has caused the same to be
executed in its name by its President, and the execution hereof
attested and its seal hereto affixed by its Secretary,
the day and year first above written.
